But Utah Department of Health officials, in a formal declaration issued Tuesday, said that loophole doesn't exist, and the smoking ban stays.

I’m not a smoker (never have smoked a cig in my life in fact), but I have a huge problem with smoking bans like this. The justification is persuasive for GOVERNMENT buildings since people sometimes have to go to those, but despite the health risks, I am not at all convinced that private property rights should be destroyed because some people choose to partake in an unhealthy activity. If the restaurant or club allows smoking, I simply don’t have to go or I can sit in a non-smoking section. Vote with the wallet and feet.

I've always thought punishing adults for smoking is pointless and cruel, so the focus should be on preventing kids from taking up the habit/addiction.

I think punishing them for such an activity violates certain “god-given” rights, but I realize that I’m in the minority on this. I agree that it makes much more sense to focus on prevention than punishment. Not sure how I feel about government spending for that though. But given that such an ideal world of minimal government is likely to never happen, I suppose one has to pick his battles carefully and do the best that he can within the system .
Utah is such a nanny state, I’m surprised to see that it took them this long to getting around to a smoking ban. Maybe the difficulty was the byzantine liquor laws they have that requires bars and taverns to be “private clubs” instead.

Interesting. That link pretty much describes every young lady I dated in my 20s. They could fake normalcy for a few weeks or months but then the veil would slip and and their "inner nut" would come out to play.
If scientists ever manage to figure out the mystery that is the female mind, then we can be sure that the end will be very near. ;)

As a smoker, I’m still waiting for my ‘piece of the pie’ of the literally hundreds of millions the tobacco companies have paid to various states under various “class action” lawsuits - the only group these lawsuits helped was big government and lawyers. imo. Nicotine gum still costs $25-35 and patches are even more expensive. If the powers that be can hand out free condoms and bc pills, why no free nicotine patches?
