Wife slain at (Montclair, NJ) YMCA had restraining order

A man being sought for shooting and killing his estranged wife to death while she watched one of their children swim at a Montclair YMCA had been ordered in October to have no contact with her. Kenneth A. Duckett was under a restraining order that specified no contact with Monica Paul, but allowed him to have visitation rights with their two children, said Paul Loriquet, a spokesman for the Essex County Prosecutor's Office.  "Basically, it was like a curbside drop-off," Loriquet said.

The couple had separated in August, but it was unclear when they had married. Paul, 31, obtained a temporary restraining order in October, and it was made final later that month, Loriquet said.  Paul was with the children at the "Y" last night. As she waited in a poolside where their 4-year-old son was swimming, Duckett approached and shot her several times in front of their 11-year-old daughter, authorities said.

Duckett fled in a white Jeep with another man, and the vehicle was later found in Orange, where the 37-year-old Duckett lived. Police are still looking for Duckett. Witnesses told police that the shooter approached Paul and that the two had a short conversation before he opened fire.

Authorities credited YMCA members and employees with pulling Paul’s children out of harm’s way as the shots were fired. The children were in the care of relatives last night, they said.  “We’ve been advised there has been a history of violence between these individuals,” said Essex County Prosecutor Paula Dow. “Obviously it tells you that with a final restraining order, it still does not prevent horrific things like this.”  Essex County Sheriff Armando Fontoura offered a reward of $5,000 for information leading to the arrest of Duckett and his alleged accomplice.

A restraining order will do nothing for the truly obsessive and emotionally disturbed. Thankfully, my now brother in law was home when my sister's disturbed ex-boyfriend broke into the house years ago.

For those not familiar with the area, Montclair is a very liberal town just NW of Newark. The population ranges from multimillionaires and billionaires all the way down to the welfare class (but, oddly enough, not too many immigrants of any stripe/income). This YMCA is just north of Bloomfield Avenue, in an OK nabe between the ghetto and the wealthy.

I firmly believe the most efficient way to deal with domestic violence against women is to teach them how to handle and shoot a gun, then make sure they are armed at all times. It’s why a gun is sometimes called an “equalizer”.

It just so happens New Jersey is one of the states considering a one gun a month law in addition to all the other onerous restrictions it places on the rights of the state's residents to defend themselves. But don't look for the liberals there to apologize to the children for not allowing their mother to defend her life from her abusive ex.

A gun wasn’t going to help her in this particular situation. Sometimes when someone wants you dead your time is going to be up.

Yep. When the law allows you to defend yourself, it actually saves lives. Try getting that through the skulls of mush in Montclair and other big lib cities around the country.

I disagree here. You have the right to defend yourself. Liberals still don't get it about the Heller decision but the American people do. Monica Paul deserved better. Oh yeah - and the liberals in New Jersey abolished the death penalty. Kenneth Druckett had no consequences to fear for murdering his wife.

She had no chance. She's at the pool, watching her kid in a semi public place and he comes up and shoots her. Maybe she could have reached in her bag, maybe she gets a shot off, maybe her kid or someone else's kid takes a round in the face by accident. I'm not saying she should have been a sheep on this but as long as damaged goods like her ex walk the face of the earth there will always be victims of violence especially when just about everyone has even a few moments when they are exposed.

I just replied to another posting you made. We all have the right to self defense and we should take every opportunity to do so. She just happened to be in a situation where she was exposed and the dirtbag took advantage of it.

RO's are garbage. People don't learn that someone who wants to kill you isn't going to be stopped by a piece of paper or by the law. They're only going to be stopped by a gun! There are times in life when the law can't protect you and you are truly on your own. I'm just sayin' its the way of the world. Its up to you to protect your life.

I would too. But I would also not trust a piece of paper to protect me, I’d leave the area, change my routine and wouldn’t be out in the open. However, when you have a determined opponent eventually they are going to get their shot.

Sad for the woman and that poor girl is going to be ruined for life.

Someone should grab up the guy and string him to a tree and bullwhip him to death.

Gary Kleck has pointed out just brandishing a gun prevents things from escalating. A criminal might very well be deterred by the fact that you are armed. He won't be if he knows you're going to beg him for your life.

Old sparky? Hardly. The brilliant people of NJ have seen fit to elect a governor and legislature that outlawed the death penalty. Even if they hadn’t he probably would never have been killed anyway.

That only works for a short time, eventually you rack up a credit record in your new residence. Anyone can find you with an online search. So make sure they find you in a gun-friendly state. :)

Not likely. A guy willing to stalk the mother of his child then shoot her in the open with witnesses around isn't going to think about that. Too rational.

I don't care what you know, what you carry or how well trained you are. There are things you can do to minimize threats but when evil wants you bad enough then you are done. I certainly think she could have taken other steps to protect herself but the fault lies with her ex.

RO’s do serve one purpose - if you DO have to blow away the subject of the RO, there isn’t even any question about whether you feared for your life or not. If you hadn’t feared for your life, you wouldn’t have gotten an RO, right? That’s the logic, and even libs won’t argue with that much.

Also, wasn’t the Lautenberg Amendment supposed to stop this sort of thing? Subjects of ROs not allowed to have guns? US. v. Emerson? Looks like gun control failed again. Anyone surprised?

I was born and raised in Montclair and swam in that pool many times.

This kind of stuff didn’t happen then, although I will point out that one of the very first Post Office multi-shootings occurred in Upper Montclair. Early 90’s I’m thinking.

New Jersey hasn't issued a concealed carry permit to a non law enforcement official in over 30 years. It's not illegal, it's just that they refuse to do it procedurally.

If the State of New Jersey had recognized this woman's constitutionally protected individual right to "bear arms" then she might be alive today.

The system has been set up to allow parents rights to see their children no matter what. Even if a man beats his wife in front of his kids, the court will not stop him from seeing the kids unless he has beaten the kids and it is proven (pretty much multiple witnesses and he is convicted with it.) It doesn’t matter what he does, or even pays child support, he is welcome to see his kids (I am using a generic “he” here. My brother-in-law raised his kids and his ex-wife is the loser.)

When my coworker left her abusive ex-husband in upstate New York in the 70’s, she packed her kids in the car and drove to Southern California. He didn’t see the kids again until they were teenagers (and then they found out what kind-of guy he was and cut off ties from him.) A restraining order isn’t going to save you if you have to stay in the same town and have some recognizable habits you keep with the kids. True, in the internet age, it’s harder to hide from someone, but it’s easier than staying in the same town, and taking the kids to the same places regularly.

I know I might get flamed, and I also know that there are people who would abuse it if the laws changed. I also know of many people whose exes should not have any more control of their life but unfortunately do.

Restraining orders are a joke. There should be some organization where thee women can hire hit men to take care of these murderous goons. Because the law surely won't.

“Police Protection” is an oxymoron. Free citizens must protect themselves.

You know, I have been reading this nonsense for years and I have had enough. Anyone who lives in fear of another man and doesn’t have the guts and brains to arm themselves with the proper tools to remedy the situation is stupid. Yes, stupid. To think that you would let some state official hundreds of miles away from the situation determine whether you should carry a concealed firearm is ridiculous! Being alive is a much better choice than being dead. If you have to break a law to protect yourself, then for chrissakes do it!

In New Jersey the decision to carry a firearm illegal is a question weighing probabilities. You have to measure the probability of it helping you against the probability of it getting you sent to jail for a minimum of 5 years.

It might seem like an easy decision for you, but here, where we are essentially living in a police state and are all constantly coming into contact with law enforcement, it's not quite as simple as you make it sound. If you feel otherwise when you come to our state, by all means let me know, and I'll come visit you in prison.

The guy shot her and fled, and seems to have had a friend driving the getaway car. This indicates he was wanting to survive the incident.

He might have been sure he would have successfully shot her, but if NJ was a CCW state he could not have been sure that somebody else in the pool area would not have blown him away shortly thereafter, which would have complicated his plans

I used to work in Richmond and North Richmond, California for a communications company. I carried a gun with me everyday of the week. I didn’t ask permission from any supervisors, elected officials, police officers or the County Sheriff. A couple of times young thugs looked at me to see if I would be a nice easy victim. Showing them my holstered revolver almost gave them instant heart attacks but it certainly opened their eyes to me being a victim. Only once did I get so worried that I actually grabbed the handgrip. That man also almost crapped himself when he realized I was grabbing a gun. He apologized and stepped back quickly, turned around and left the area.

Looking back I am positive thatover the years my actions kept other employees from being attacked. I am certain that word got spread around rapidly not to mess with them phone guys ‘cause them buggers carry guns tucked away under their jackets.

Now, one more thing. I don’t look like a punk or a thug. My hair isn’t long, I am not covered with tatoos and I don’t listen to rap music. I imagine this is part of the reason why I can sit next to a police officer at a coffee shop counter and enjoy a conversation during my meal with my revolver snug in it’s shoulder holster. I have never had an LEO frisk me for weapons, drugs or anything else. I just don’t look like the criminal type. Perhaps that is what gives me the confidence that I can carry without being molested by the cops.

This woman was trying to do exactly that...Be alive.

I know (& in some cases knew) women in this very same position.
Some of them are easier targets because they share children with these men.
Others are simply trying to work and are easy to get at because of their routines.

I'm sure many of the men who murder their wifes/ex-wives/girlfriends weren't wearing a mean look & a billboard that said 'RUN AWAY QUICKLY!!' when they first started dating...
