DALY CITY -- A San Francisco man is expected to be charged with murder Tuesday in San Mateo County Superior Court for allegedly stabbing a fellow patron at a Daly City restaurant after the victim made crass comments about a waitress, police said.
Both Jesus Hernandez, 33, and Carlos Padilla-Ovedio, 25, were at the Durango restaurant about 5 p.m. Friday when Hernandez apparently began making "rude comments to the female waitress," police Lt. Jay Morena said.
Both men were "semi-regulars" at the small restaurant, Morena said.
After hearing Hernandez's comments, Padilla-Ovedio stabbed him in the torso and ran out the door, police said. Hernandez was taken to San Francisco General Hospital, where he was pronounced dead.
It was unclear whether the motive was a desire to be "a knight in shining armor saving the damsel in distress, machismo, or he just got tired hearing this guy popping off," Morena said.
Employees knew Padilla-Ovedio only by his first name and described him as an illegal immigrant from Honduras

Personally I think it should be legal for the waitresses to stab rude, no tipping patrons.
Waitressing is a hard job. I respect waitresses, especially the old pros who are fast and don’t take any lip but always have a clever comment and a sense of humor.
I like my plumber and my electrician, guys who can actually do something and do it well rather than all the self appointed pseudo “intellectuals” who can’t do a damn thing except talk and screw up everything else.
I like do’ers not talkers. The world is drowning in baloney and BS. There should be a tax on gubmint talkers, taxed or penalized on every excess word and length of time talking.

In this case, a stabbing went too far. A blow to the head and a kick to the shin (to knock him off his feet) was more warranted in this situation.
