GEORGETOWN An Austin woman was sentenced to 23 years in prison Wednesday for having sex with a 16-year-old whom she lived near last year in Round Rock.
Phill Raije Rian, 41, shook vigorously as a Williamson County jury sentenced her. She was convicted Monday of three counts of sexual assault of a child.
The jury recommended 10 years for one count, 13 for the second and 10 years' probation for the third.
Judge Billy Ray Stubblefield stacked the first two sentences, meaning she will serve 23 years in prison and 10 years' probation.
She won't be eligible for parole until she has served half the prison term.
The teen testified last week that he and Rian had a relationship and planned to marry once he was of legal age. He also said he and Rian had sex several times.
The boy's parents became suspicious after she bought him a cell phone and he began spending a lot of time at her home.
"She needs serious help," Assistant District Attorney Phil Grant said during Wednesday's sentencing phase.
But during testimony on Tuesday, the victim's mother said she "was sure" that Rian did not force her son into a sexual relationship.
"We told him, 'You made a big-boy decision, so you need to face big-boy consequences,' "
the victim's mother said.
Rian's two children, ages 5 and 3, are in Child Protective Services custody, and a custody trial is pending in county court.

This is trying to substitute mythology (in this case, the idea that all actions by men and women are of equal weight) for reality. Sixteen year old boys simply do not get pregnant, or at least I’ve never seen it. They’re wanting to inflict on this woman the same punishment which they would justifiably inflict on a grown man caught doing it with a teenage girl.

From his testimony that they "planned to marry" implies that it was voluntary on his part, so the only question is whether it was statutory rape, and the article gives no information on that. The only reference to being "of age" was about the planned marriage.

This is nuts. I’ve been in favor of lowering the age of consent (for males at least) to 16, and this sentence is a good example why.

It's too much, in fact, if the parents were cool with the woman and they might have planned to marry someday, then the hell with the conviction, too.
A 41 yr. old woman has a sexual relationship with a 16 yr. old boy. Now, she’s going to jail (and she must have known that was possible the first time she had sex with the boy) and her two young children, aged 3 yrs. and 5 yrs., are in state custody.
23 yrs. for being a selfish, irresponsible whore sounds right to me.
I may be getting older, but most of the 16 year olds I hung out with would jump at a chance to experiment on a 40 year old hot babe, in fact they would have walked over broken glass with bare feet to do it.
What a bunch of idiots:
1. The woman of course for breaking the law and telling everyone by buying the kid a cell phone etc.
2. The judge for not understanding justice and the law a single bit. I am sure the judge probably “read” the litteral text correctly, but the purpose of criminal law is to protect society. Society has little interest in underage consensual sex between two people who plan to marry. Society has little interest in consensual sex when the burden, ie in resulting children, will fall on the of aged party.
3. The jury in allowing an idiot prosecutor and and idiot judge to cost them and the rest of the Texas tax payers paying for this woman’s incarceration for at least 11.5 years? Have they not heard of jury nullification? Just because some government blowhard says they should sanction the government paying to incarcerate her for a long time for this act, does not mean they must go along with it.

When I was young, the age of consent WAS 16! (for both sexes in most states!) There was even a humorous saying that reflected the fact: “15 will get you 20(years)!” and 15 year old girls were known as “Jailbait.”

It varies by state, ranging from 16 to 18. I think it ought to be 16 everywhere.
