DURHAM -- Lawyers for accused Duke lacrosse player Reade Seligmann want a judge to hold hearings Thursday on whether to compel police and prosecutors to turn over the evidence they've compiled while investigating the alleged gang rape.
The motions have to be heard now because there's a risk that evidence that could exonerate Seligmann "will spoil if not preserved properly," lawyers Kirk Osborn and Ernest Conner said. They said that could happen due to political pressure Durham officials might be putting on investigators.

I watched an innocent man talking to the press yesterday.
You can see it in his eyes.
mark. Patrick Baker.
Excellent. Let's hope the judge knows what's going on and grants that motion.
Beker didn't mention whether the "said she was raped by 20 men" comment, overheard by Duke officer Day, was said by Durham police Sgt. Shelton or not.
We know DNA samples are delicate for want of a better word. They don't want to lose the DNA of the boyfriend. There's supposed to be a chain of custody on these samples. When NiFong personally picked up the report, did he also pick up the samples?? He should not be handling it.
I read where another candidate can run against Nifong and have their name included on the ballot, if they file by the end on June, as a Republican?
I would like to suggest that the Republicans get together and recruit Freda Black to run again against Nifong. Black pulled in a very good percentage of the Democrats in the primary. If Black would choose to run as a Republican, and she kept a good percentage of those who supported her in the primary, and in addition, she were to capture a sizable majority of the Republican voters, then maybe we would see Nifong defeated at the polls in November.
I would also think she would receive a lot of campaign contributions for her campaign from the many people who are disgusted with the way this DA has handled this case.
If not Freda, then please, I call on the Durham County Republicans put up another candidate?
I think state law prohibits her from running once she lost the primary.
They are; so far he hasn't coughed up anything.
North Carolina is an open files discovery state; they are entitled to every scrap of paper they have.
Wonder what he got his indictment is.
Let's hope for more bad news for Nifong today.
so the defense has not seen a scrap of the DA's evidence yet, but they are entitled to under NC law?
My guess is that this accuser will never go on the stand. She couldn't hold up to cross examination by a second grader. Too many lies from the start.
Yep; we're an open files state.
He has said he's "not finished."
His problem is that he was already suppose to show the Grand Jury exculpatory evidence and he didn't do it.
The indictment of Evans, for sure, may be thrown out.
i am sure the defense attys are aware of what they are entitled to and will go after it with no holds barred. more power to them. cough it up, nifong.
he was required to show both exculpatory and incriminatory evidence to the GJ? well no wonder he SCRUPULOUSLY avoided any contact with the defense, as it ensured he HAS no exculpatory evidence!
>>He has said he's "not finished."
AKA "The dog ate my homework."
I think you figured that out.
In an interview published yesterday, the accuser's parents whined that their 'little girl' was not being treated fairly. Good grief.
Oh, they know:

He filed his motion yesterday during the blowout press conference.
The DA is withholding discovery??
"For weeks, defense attorneys have stood in front of TV cameras and countless interviews to eagerly pronounce the innocence of Duke University lacrosse players accused of rape."
I must have missed all those "countless interviews."
with their unerring eye for the deep pockets among the LAX players, they also bought themselves the opportunity to go up against the best defense attys in the state, and more likely, country. and they will eviscerate that prosecution.
Good Morning, and thanks for the ping.
Yep.
Three, by my count.
Anybody see anymore?
you know, there is always the possibility that this guy is brilliant, and is going to pull a rabbit out of his prosecutorial hat and make the rest of us, and the highpowered defense attorneys look foolish. but given that his previous experience has been traffic court til fairly recently, i just don't think the odds are in favor of that outcome.
Did you hear that the "matter" found on the fingernail was ON TOP OF IT?
If there was DNA on that fingernail, why wasn't it on her REAL nails?
And why isn't he indicting the fourth player? Is he getting a "bye?"
I keep hearing the Ellen Jamiesons on TV saying that "he does have the SANE report that shows bruising and vaginal tears."
Nobody has even SEEN that report (unless he has selectively leaked that, too, like he did the DNA report) so how could they know for sure what it says?
NOTHING about this case makes sense. not a SINGLE thing. not the behavior of the accused players themselves, not a single fact that we KNOW, makes it seem remotely possible that he has a case here. EVERYTHING is to the contrary.
and that report combined with semen from a totally extraneous third party proves WHAT? nothing.

This site asked for legal opinions of Nifong's handling of this case. Response #5 is from a University of Maryland Law School professor and is especially good.
"I have never heard of anyone as unethical or venal as Mike Nifong."
Just like somebody said yesterday: her ID of Evans with a mustache makes that 90 percent DNA "match" zero.
Did you hear that the "matter" found on the fingernail was ON TOP OF IT?
Really?.....contaminated evidence from the wastebasket....
He's innocent, but the look in his eyes has nothing to do with it.
I will root for once in my life, no make that twice the first being for the brillant lawyers during the 2000 election and their beating down of gore's team; and these lawyers who will slam dunk the lying skant stripper and nitwit nifong during the trial, does n.c law allow the proceedings to be televised.
The writer is either confused about Nifong's SEVENTY interviews or else he's deliberately planting false info. I go w/the latter motive myself.
I want to hear Nancy Grace's explanation/spin of how the accuser got FLESH on the TOP of that SINGLE fake nail.
Let's hope for more bad news for Nifong today.

Well the only thing he has in this case is a flawed ID. So what more bad news could he get?
Afterward, attorney Bill Thomas of Durham -- who represents an un-indicted lacrosse player -- said semen found in the dancer's body was "of recent origin" and had been deposited there "immediately prior to her being examined" in connection with the alleged rape.
well if the semen they found doesn't belong to a Duke LAX player it sounds pretty damn exculpatory to me.
the question isn't even if she was RAPED, the question is, was she raped by those that she is accusing of having done it.
"If Mr. Elmostafa's account is accurate, that the investigators asked him if he had anything new to say about the lacrosse case and when he said 'no,â? took him to the magistate, then the police detectives involved committed a felony."
Just like we thought.
just like you said, SG!
