If I were not so pure, I might want to ask whether the woman in the dark bed room was better looking than the woman he went home with. Thank goodness I am pure.

How can it be rape if both participated willingly?
Does she not have some obligation to know who is actually in her bed?
Do I totally believe this scenario - no.
But her claiming she didn't know makes his defense that he didn't know operable.

A MAN who claims he mistakenly had sex with "the wrong woman" Haven't we all done that before?
To: Bogeygolfer
I'm seeing this as rape. The way I read her comments is she was asleep when the sex began and she woke up during the sex. After heavy drinking it takes awhile to fully wake up. If she consented and wanted to participate do you all think she'd freak and run out and tell her friend and boyfriend?
Not that I'm taking the total idiot's side that got in bed with her, but might this not be a situation where there was no criminal intent?
This situation is so weird I'm not really sure what should happen. No, I take that back. They should both be locked up.

My own theory. They were having consentual sex, then the boyfriend showed up.

It must have been VERY VERY dark in that room.......It also must have been one of those "sensory deprivation" rooms as well.

Given that the room was real dark, what does it matter?

To know who you are consenting to is the womens responsibility.

This sounds much like an incident from New York several years ago.
A young man was using roof tops as a way to get around one night. As he passed a open window in some manner a young woman told him to hurry in. He did as ask and they engaged in sexual intercourse. She thought he was her boy friend who she had been waiting up for. He was charged with rape and either the charges were dropped or he was acquitted.

That's an interesting point. If a room is dark, does it matter whether you are in bed with Helen Thomas or Nicole Kidman?

Perhaps. It would certainly explain a weird situation. The only problem is that is in none of the information at hand. Additionally methinks the accused would have said as much right out of the gate and again, according to the minimal amount of information we have, he is not contesting the sequence of events. Of course we all having fun speculating on a very short article.
