You do not need proof of a crime to take someone into custody. That is not how our legal system works.
People are arrested upon suspicion of crime, not proof of crime.
Proof is for the courts, not the police.
Let’s say they arrest him.

What prosecutor is going before a judge with a YouTube video about what he might/could have done?
Do you really think that is how criminal investigations work? If someone breaks into a store and is caught on camera, do you think that a prosecutor simply takes that camera footage, goes to a judge and says “here you go, your honor”?
There is an investigative process. That is used to uncover additional evidence and build a case.
As far as the charge, 21-2-603 would be a good start. Of course other options are possible.

To me, it sounded like you felt I was saying that this YouTube video was enough for a prosecutor to go to court with. If you meant something else by it, please let me know.
