I am of the opinion that to respect the separation of duties with regards to the legal system; that the judge has no choice but to dismiss when both parties agree to the dismissal. The ONLY determination that is left to the judge is to dismiss with or without prejudice.
To dismiss WITH prejudice would require that an overt action that is determined to be particularly egregious - such as the intentional withholding of exculpatory evidence.

Since he could not call the judge by phone, in writing or through a courier pigeon, I re-assert that obozo notified Sullivan via the DC media with a pre-planned “leaked phone conference” to small group of “trusted” demonkraps that Flynn’s guilty plea should not be allowed to be dropped. Sullivan responded in a way to make the illegal ex parte communication not be so obvious.
I assert further now judge will wait til after the election b/c a Biden atty general will get in and undo Barr’s dropping the charges after having had enough time for “a fresh look”. Then he will deny Flynn’s notice to withdraw his plea and find him guilty. If Trump wins, he will deny Barr’s dropping the charges and sentence Flynn. In either scenario, it matters not to him how the appeal comes out of the Supreme Court - the judge will have destroyed Flynn’s life, and made it hell for over 4 years in hopes of supporting the deep state’s Russia hoax narrative as not being definitively proved by “partisan Barr” and “unindicted criminal” Trump.

Sullivan was going to rule on Flynn back in December 2018... He went a little nuts (said some things in court that he apologized for) and delayed it. Now it’s still going September 2020. That kind of put appropriate dispatch” under the table.

The minute order filed by Judge Emmet Sullivan outlines a protracted time-frame for the next sequence of events in the case against Lt. Gen. Michael Flynn:
As noted in the order, Sullivan is now telling the DOJ and Flynn defense to file a joint status report outlining their “recommendation for further proceedings” by September 21, 2020. From there a briefing schedule which will require both parties to respond to Sullivan’s personal amicus (Gleeson), and additionally respond jointly to any other amicus not ordered by the court. Lastly, Sullivan is requesting three dates for oral arguments.
In essence, despite his ability to quickly convene the parties to settle all matters before the court; which includes the unopposed motion by the DOJ and defense to drop the case; Sullivan intends to drag this case out as long as possible and use the amicus as a tool forcing responses from both parties (DOJ and Flynn). So much for the “quick dispatch” outlined within the DC Circuit opinion, this case is going on for several more months.

Barr and the prosecutor need to state that as far as they are concerned the matter is over and they will not respond to Judge Sullivan. Sidney Powell should do the same. If Sullivan proceeds to sentence Flynn, then Barr should state publicly that DOJ will not enforce Flynn’s sentence and that anyone who would try to detain Gen Flynn would be arrested and tried for kidnapping

Oddball thought, can Flynn sue for wrongful prosecution before the charges are dismissed? If I’m him, I need to sue for wrongful prosecution/misprision of office to make myself whole, but I can’t until dismissal. Guess who my targets would include? The guy who proposed using the Logan Act, which would be a huge black eye for Joe if filed before the election. I know he would never be deposed before November, but he would have to delay his answer at a minimum, and it would look bad.
I’m coming to agree, The DOJ and Flynn should immediately submit their proposed schedule of the 22nd, 23rd, and 24th.

Judge Emmett Sullivan is what I said in the beginning, an ardent democrat. He is fooling around with Michael Flynn’s case to keep it going until the November election. He knows in the end, the Supreme Court will throw out Flynn’s case, but he wants the propaganda advantage against Trump for the election. Judge Emmett Sullivan is a slob and should not be a judge!
