District Court Judge Emmet Sullivan has issued an ordering directing the “Parties” to take certain steps in the aftermath of yesterday’s decision by the Circuit Court of Appeal to deny the Petition for Mandamus.

As I noted in my story yesterday on the decision, at the very end of the opinion the Appeals Court “directed” Judge Sullivan to resolve the matter “with dispatch” — which is a backhanded way of saying he had not acted in such fashion up to this point in time.
Judge Sullivan has entered an Order today which essentially ignores all the briefing that took place before the Appeals Court, and directs the “parties” to do more briefing and then get together and agree on three proposed hearing dates. They are directed to file a “joint status report” recommending “further proceedings.”
The Order says the “joint status report” should be filed by “the parties” “no later than Sept. 21.”
My view is that Gen. Flynn’s counsel and DOJ should take the position that they are the only two parties, and file a Joint Status Conference for just the two of them — not including amicus counsel.
Amicus counsel was named by the Court to assist the Court. Amicus counsel is not a “shadow” party. Gen. Flynn and DOJ should force the Court to enter Orders directed to amicus counsel in a way that isolates Judge Gleeson as a non-party, or force Judge Sullivan to treat him as a de facto party rather than simply an advisor to the Court.

This asshat judge is using delaying tactics to take this past the election date in the hope of Biden being elected. Then he’ll sentence Flynn to life in prison as a warning to punish anyone who dared to help Pres. Trump.

Arrest him for contempt, remove him from the bench, disbar him, and reset his notion of who is in charge. Like most on the left, their out of line actions are never punished.
I am of the opinion that to respect the separation of duties with regards to the legal system; that the judge has no choice but to dismiss when both parties agree to the dismissal. The ONLY determination that is left to the judge is to dismiss with or without prejudice.
To dismiss WITH prejudice would require that an overt action that is determined to be particularly egregious - such as the intentional withholding of exculpatory evidence.
Then shoot him!
There is a subtle difference between “scheduling” and “calendaring”.
“calendaring” (at least how it was used within IBM) refers to reserving time on the calendar but not yet coordinating with all parties
“scheduling” refers to an agreement between parties for a particular date and time.
Not sure if that is the correct usage, just how I have seen it used before.

Since he could not call the judge by phone, in writing or through a courier pigeon, I re-assert that obozo notified Sullivan via the DC media with a pre-planned “leaked phone conference” to small group of “trusted” demonkraps that Flynn’s guilty plea should not be allowed to be dropped. Sullivan responded in a way to make the illegal ex parte communication not be so obvious.
I assert further now judge will wait til after the election b/c a Biden atty general will get in and undo Barr’s dropping the charges after having had enough time for “a fresh look”. Then he will deny Flynn’s notice to withdraw his plea and find him guilty. If Trump wins, he will deny Barr’s dropping the charges and sentence Flynn. In either scenario, it matters not to him how the appeal comes out of the Supreme Court - the judge will have destroyed Flynn’s life, and made it hell for over 4 years in hopes of supporting the deep state’s Russia hoax narrative as not being definitively proved by “partisan Barr” and “unindicted criminal” Trump.

Sullivan was going to rule on Flynn back in December 2018... He went a little nuts (said some things in court that he apologized for) and delayed it. Now it’s still going September 2020. That kind of put “appropriate dispatch” under the table.
