BREAKING: “Non-Essential” Business Wins Huge Court Case Against State After Refusing To Close Doors To Public

On April 16, authorities arrested 36-year-old Galen Wood, owner of Kitchen Table Games in Pinellas Park, FL for operating a “non-essential” business and violating a safer at home order.

Wood was charged with operating a non-essential business and traveling to operate a non-essential business.

Wood was issued a warning on each occasion, before deputies conducted a non-essential business compliance check at his store on April 16. Wood refused to close the store and was arrested shortly after.

Wood is the first Florida business owner to be arrested under such orders.

Today, State Representative Anthony Sabatini announced on Twitter that the 6th District Circuit Court dropped their case against Galen Wood. Sabatini, the firebrand conservative who represents House District 32, who took a quick break from his legislative duties to legally represent Galen Wood, the owner of Kitchen Table Games in Pinellas Park. FL.

According to Sabatini, the court’s decision makes it clear that there is NO valid legal authority for either the state or local emergency orders.

Many Conservative lawyers have stated that these orders are unConstitutional and if challenged the owners will win those challenges. This is not the first. It is the fourth such case I’ve heard of in the last few weeks.

These cases are eventually going to end up at the Supremes and dictatorial governors and mayors are going to lose.

article was written by someone totally ignorant of how the law works ... the COURT did not drop the case: it never got to court because the State’s Attorney dropped the case so the court couldn’t rule ...

no doubt, the Florida State’s Attorney dropped the case because he didn’t want to risk losing in court and having
the boot of the state removed from the neck’s of ALL Florida citizens instead of just this one

They better. I don’t need another “it’s a tax” weasel ruling.

My guess is they’re going to find it’s ok for locales where the virus has spread out of control and not for general preventative measures.

Ummm.. not so fast. If the Court "drops" the case it doesn't mean there was a ruling about legal authority. They just dropped this case.

I doubt ANY circuit court is going to press the issue. Not the brightest move by the LEOs.

Govt has no authroity to determine what businesses are ‘essential’ or not.

ALL BUSINESSES ARE ESSENTIAL.

Hooray Anthony Sabatini State Rep future Presidential material. (I’ve never seen this site before. Could be used for nefarious purposes. /Worst case scenario thinking. I must admit...I know where several congress people and the governor of Michigan live. All through friends and my own experiences...never looked for them online...dunno...just saying)
