So we have McCabe’s memos that apparently confirm Comey’s memos. Why should we believe anything they say when they both have lied under oath?
But he's full of sh*t if he thinks somebody's own notes, not certified by anybody, are better than court witnesses.
When did he write them? During the meeting, afterwards or when he knew he was going to get fired? Did he follow this practice with every meeting he had? If not, why do this with just Trump? Why would his recollections after the fact be any more accurate than Trump's?
Lots of issues with these notes being used as evidence of anything other than what this guy had on his mind at the time.
Unless these "notes" were witnessed by someone else in the meeting, and they signed as such, these are just pieces of paper that anybody could have written anytime about anything they wanted.
I can just see it in court, "Hey judge, I wrote a note accusing my boss of some crimes. Would that be enough to get him fired?
Judge Andrew Napolitano FOX legal analyst.
Judge Nap was taken to the woodshed by FOX a few months back, since then he has been less than trustworthy in my opinion. He raved how Comey's contemporaneous notes would be very accurate just because all lawyers do that.
Some may not know that the only records kept of FBI interviews are form 32 notes and no recordings are made because an FBI agent would never ever lie.
But he's full of bunk.
Anybody that keeps notes/memo on their meetings, would do it for everybody they met with. Does he have all of this notes? If so, then it was his common practice.
But if not, then he wrote these notes to CYA himself after the fact. And, as such, they would be biased against Trump and favorable to McCabe. Who would write these notes/memos and make themselves look bad?. Trump said he wasn't taking notes during the meetings.
Any defense attorney could easily challenge the veracity of anything contained in the notes. They would be worthless in court as evidence of anything.
Courtroom: McCabe: "Judge, I have here in my hand, evidence that Trump obstructed justice." Judge: What is the evidence? "Oh, just my notes I made sometime after I met with him." Judge: "I said 'what is the evidence', not what is your opinion."
So I disagree with this Fox News judge.
The FBI form 302 is what agents use to makes notes of their interviews. These are the forms McCabe is accused of asking agents to change and falsify to cover their trail.
He is a Libertarian which explains some of it, but He made a sharp left turn after FOX suspended him for a couple weeks.
