The federal government t has used federal tax dollars as leverage against states in order to compel them to: raise the drinking age to 21, to adopt a 55 mph speed limit and to mandate the wearing of helmets. And in 2009, Chuck Schumer attempted to use federal highway funds as leverage against the states to force them to outlaw texting while driving.
In South Dakota v. Dole, the Supreme Court found that, under the spending clause of the Constitution, the federal government could withhold highway funds, thereby exerting its control over the states.
