Maybe John Roberts did us a favor by saving ObamaCare

By leaving it for Congress to dismantle, the Chief Justice ultimately set the stage for a better solution

I’m not going to lie to you. I was as mad as anyone at Chief Justice Roberts when he - not once but twice - saved ObamaCare by engaging in legal gymnastics to avoid finding it unconstitutional - which it clearly was. First he pretended individual mandate fine was a tax, even after the Obama Administration had explicitly said it was not while trying to sell it to the public. Then he ignored clear language about who had to run the exchanges in order for them to be eligible for subsidies.

The other conservative Justices (even Anthony Kennedy) were ready to throw out the entire law on the grounds that it exceeded the authority of Congress. We thought Chief Justice Roberts saw the law the same way, and we suspected when he decided otherwise that he was worried about his “legacy” as Chief Justice and about how he would be pilloried by the media and by liberal historians.

Yup. His job isn’t to gauge the political repercussions. As he famously said, he’s an umpire. If the batter is out, you don’t rule him safe to set up the double play.

So, Roberts is happy that with one absurd decision he has become a laughing stock of conservatives who will never trust him again.

He has become, in a word, irredeemable.

It’s better that we get to replace Obamacare than the Dems coming up with something new themselves if the Court had declared it unconstitutional. It’s like the election. Our 2012 loss paved the way for a much better president elected in 2016. Sometimes losing puts you in a much better place in the long run.

He took the coward’s way out.

He did not want to get his hands dirty taking down the signature achievement of the first black POTUS.

Granted he probably thought the thing was going to
collapse of its own weight anyhow.

The Court is not so deferential to the Legislative Branch on issues like gay marriage and abortion.

Not being privvy to his private reasoning and as angry as anyone the last few years, could this have been a factor in why the silent voters decided show up last month? Sounds simplistic, but everyone is not so involved.
