The legal team for U.S. Army Sergeant Bowe Bergdahl on Monday asked to have the charges against the former prisoner of war dismissed, arguing comments made by Senate Armed Services Committee Chairman John McCain violated his due process rights.
Bergdahl, 30, is facing a court-martial with a potential life sentence on charges of desertion and endangerment of U.S. troops after he walked away from his post in Afghanistan in 2009 and became a Taliban prisoner for five years.
Defense attorneys argued in a motion filed on Monday that comments made by McCain and the committee's general counsel, Steve Barney, have unduly influenced his case. The filing quotes McCain as saying last October: "If it comes out that (Bergdahl has no punishment, we're going to have a hearing in the Senate Armed Services Committee."

Why is he not facing the death penalty???
Hang the SOB already!
So McCain was so harsh against Trump today...Had a love feast towards Khan.......and the same day this comes out. because of McCain he could walk......someone needs to eat crow
McCain is a traitor of a high order. Not many people have the distinction of doing more to impede and screw over MIA and POW’s than him. And the entire time he gets a pass because he was a POW. Kerry is up there with him during the 80’s and 90’s when the two of them worked overtime to screw over their suffering fallen brothers in arms. Just like McCain to get this arguable traitor off - just the way he rolls.
well there ya go, McCain - the same vermin after Trump are after you, now. How say you?
I don’t think he screwed up I think he accomplished his mission.
And I hate McInsane.
Amen to that! He is responsible for writing off 1500-2500 MIA's just so the US could trade with the commies in Viet Nam. He is a genuine scumbag and traitor, TO HIS FELLOW POW's and MIA's.
I was wondering about this goof the other day when that girlyboy in jail tried to off him herself.....Well I guess I see it has awoken.
Perhaps it was deliberate.
No deal. No one pays any attention to what dipshit McCain says.
I don’t think that this will be granted because Senator McCain is NOT in the military chain of command.
And what’s wrong (as a violation of someones’ right(s) ) with saying, “If nothing comes of this through channel A, I’ll see to it channel B opens up” ?
Under the UCMJ, the only “undue influence” is from the chain of command whose statements could be considered as “an order” to the members serving on the court-martial jury. A senator’s comments cannot be considered ‘an order’ because he is not in the military chain of command; even if he is a retired officer.
