Cop friends have told me there have been cases of thugs painting their real guns. I assume to make victims or cops hesitate when they see the orange tip.

Of course this fact is usually kept quiet when it does happen. I imagine it does more often than we know...

Exactly, he was a 12 year old with a toy gun. Nobody came forward saying he was scaring them. I would have been killed by the cops at age 12 too by this standard.
And as for the orange cover, no self respecting boy would let that stay orange.
And it wasn’t like the cop waited around to see it anyway.

You're on the right track here.

In my youth, I spent many a day shooting my BB gun at targets behind my house. And my BB gun looked an awful lot like a 22 rifle.

And I'll tell you something. If a cop rolled up 3 feet away from me, then started yelling, I would not have dropped my BB gun. I would have turned towards the cop, as confused as confused could be.

If that happened today, I would have been shot. And then all the cop apologists would be saying how I pointed my "gun" at the cops, and it was a good shoot.

I’ve never heard a single hint that Tamir has done anything except be a typical kid. And even if the town has some crime, those idiot cops screamed across the grass with a few feet of him and gunned him down before the car was fully stopped.

In the video I didn’t see Tamir do anything even slightly aggressive.

And nice touch to do no first aid whatsoever. There isn’t any polishing this as ok.

In the video there are no bystanders. He appears to be alone in the park. Just looks like any boy you ever see with a toy gun. Also, no bystanders came forward to say they had been aimed at, etc.
Even the crank who called the police told the police it’s probably a toy.

This kid wasn’t some Michael Brown or Trayvon who deserved it.

Your Daisy air rifle wasn’t a replica of a semiautomatic hand gun and you were probably smart enough to put it down if you’d been approached by two police officers in a patrol car. His pellet pistol just wasn’t cool with the pesky orange tip left on so he or someone removed it before he went to a public park to play act all bad (a closed circuit surveillance video is available). The gangsta culture this kid and millions like him are immersed in every day is what got him killed. I expect that is what the police union president (in Miami, not Cleveland) meant when he referred to acting like a thug.

I'm defending the right of people to carry guns (and kids to carry toy guys) in public without getting shot by the police. I don't believe any worthwhile purpose is served by joining in the media/Democratic Party hysteria over guns.

From the Wikipedia article:

1) Police said that as they pulled up, they saw Rice grab the pellet gun and put it in his waistband. This is not supported by the video. Judge Adrine said the video does not show the pellet gun in Rice's hands in the moments immediately before as the zone car approaches.

2) Police said that Rice then reached into his waistband and pulled out the pellet gun, and was then shot and killed by Officer Timothy Loehmann. The video shows that Rice did not pull out the pellet gun. In the video, Rice is using both hands to hold his shirt up and expose the pellet gun to view just before he falls to the ground.

3) Police described the pellet gun as looking real and later explained that the neon tip of the pellet gun was missing. However the police never saw Rice brandish or point the pistol at them to determine if the orange cap was actually missing or not.

There is apparently video evidence which casts the claims that this kid pulled a gun on the cops into doubt. Shockingly enough, cops are capable of making things up to cover a bad shooting. I completely understand how difficult a job police have, and I'm aware that the vast majority are good people and true public servants. That doesn't change the fact that there have been and always will be a few bad ones, and they can trample on your rights and take your life just as easily.

You are correct on both counts. But there's still a problem. If you haven't seen the video, check it out. The cops pulled up to within a few feet of the kid. They gave themselves literally zero time to properly evaluate the situation. The cops deliberately put themselves into an immediate-shoot situation.

If I were on a criminal jury, I would not find those cops guilty of criminal behavior. Their behavior was not criminal.

But it was reckless, and tactically stupid behavior. I expect a trained cop to exercise better judgment than a civilian, especially a kid. So if I were on a civil jury, I would award the kid's family a huge chunk of change.

The video shows no such thing. It shows him walking casually towards the cop car careening up, and he is instantly shot down.

Somebody did come forward and called the police that a man was in the park pointing a gun at people.

So he was scaring somebody

Only dead cops wait around to determine if the gun is real or not

I’m thinking that the keepers of the police should talk that big to Ferguson adults and teenagers, to the US Justice Department thugs, and the FBI investigators.

But, you’re so right, taking on a poor dead boy, a poorly raised twelve year old is simply the testosterone heavy mouth work of a goon.

No, he was annoying the caller. The caller never said it was pointed at him. And the caller also said it looked like the kid had a toy.

And you don’t get to use the cautious officer defense when you scream up at full speed and skid to a stop 5 feet away from the suspect, jumping out, guns blazing.
That was crap police work.
And the legal term in the civil suit will be “Officer induced jeopardy”.

I agree with you. And for extra fun, this was an open carry state. They screamed up and simply shot him down. That could be anyone here. And no, the video does not show him drawing a gun.

This lunatic cop had some sort of breakdown at another department during firearms training. He was fired with the comment that his problems were severe enough that they would never get better with additional training or time.
