MI: Disabled Vet Apprehends Criminal; Cited for Shots in Air (video)

One of the limits to the legal use of deadly force was illustrated by a recent incident in Detroit, Michigan.  A disabled veteran caught a robbery suspect, and attempted to hold him for police.  After about five minutes, the suspect ran away.  The vet shot in the air in an attempt to stop the suspect, but it did not work.  From clickondetroit.com(with video):
"The criminal hit me with something in the back of my head," the veteran said. He did not want to be named in this story.

The robber was trying to steal the man's gold chain. He chased the robber and returned to the restaurant a few minutes later with the robber held at gunpoint.

"I pushed him and I told him, 'Punk, sit down. Punk, sit down,'" he said. "He looked at me and thought I was an easy target because I'm disabled, but don't let the smooth taste fool ya. That's how he got caught up."
When the police showed up, they cited the veteran, who has a permit to carry a concealed weapon, for shooting inside of city limits.    They did not confiscate his pistol, which appears to be a Taurus 24/7 pro with ambidextrous safety. 



The veteran is carrying the Taurus in an inside the waistband holster, without any additional retention. 

In a case such as this, the veteran might have been able to get assistance from other customers.  The suspect was not complying; they could have taken pictures.  Perhaps they did so.   It is hard to believe that the suspect will escape custody.

There has been a big turn around in Detroit. Self Defense with a firearm is now celebrated. Notice that the police did not confiscate this veterans personal defensive firearm.

Shooting in the air is kind of pointless which led to the citation but an overall good story.

Don't shoot in the air, always use a safe backstop, like a perp's torso.

In this case, he did not have justification to shoot the fleeing suspect, so calling “misses” warning shots, might have been the better idea...

I believe that he was telling the truth.

This is a situation where a gun is problematic because of its three modes: holstered, brandished or firing. The vet had the perp sat down, and the perp saw an opportunity and barreled past the vet.

Importantly, I agree that it would be a legal problem had the vet shot him. Definitely, had he done so on video. But there is another way, and one I often encourage.

Along with your gun, carry a knife. It is the superb complement to your gun. In this case, once the perp was seated, pull the knife and holster the gun.

It solves the problem of the hard choice whether to fire the gun or not, if it may be inappropriate to do so. And to barrel past you, the perp would have to run headlong into the knife, something for which you are clearly blameless.

Plus, a holstered or brandished gun can be *stopped*, a martial arts term which means deflected, parried or otherwise kept from pointing at you. It is sometimes used when both your guns are hip holstered at very close range. While drawing your gun (right hand), you put your left hand on top of their holstered gun, slowing down their drawing of their gun while yours is now ready. You’ve got the drop on them.

You can’t stop a knife once it’s out of its sheath.
