I think it would be trademark infringement, and given the current state of trademark law precedents on both sides of the pond, probably they could sue with some chance of success.

Of course, were the standard principles of trademark law actually applied uniformly, the answer would be no. First they operated in a different market, second there is very little chance of confusion between groceries and leftish public policy (though if she revives a “chicken in every pot” sort of rhetoric their case would be stronger), and third, it seems to be an abandoned trademark since Tesco is not trading as Hillards any more.

Copying a trademark, even accidentally...NBC paid big bucks for a new logo in the 70s only to find Nebraska public tv had same thing..2 trapezoids forming the letter N. NBC settled out of court I think and after awhile superimposed the peacock on the N, then got rid of the N

If you look at Cruz’ symbol, it’s a flame, upside down it’s a tear, lean your head onto your left shoulder, it’s a woman’s eye, lay your head on your right shoulder, it looks like an unborn child. Very evocative.
