Fed. Court Ruling Opens Door To Gun Rights Restoration For Certain Misdemeanors

The Second Amendment Foundation has quietly won a significant federal court victory in a Pennsylvania case in which the judge has ruled that a man convicted of a serious misdemeanor crime several years ago, but who has demonstrated that he “would present no more threat to the community” than an average law-abiding citizen, may not lose his Second Amendment rights under a federal gun control statute known as 922(g)(1).

So that speeding ticket I got a few years ago shouldn't be used to deny me my rights after all. LOL! Remember the good old days when it was felons that were restricted?

There should be NO weapons restrictions on any free person. Anyone who can’t be trusted to be armed should not be running around loose.

I think the discrepancy is on the definition of a felony, federal law says you lose your gun rights if you are convicted of a crime in which you could be imprisoned for over 1 year, which in most cases would be a felony, however some states have misdemeanors which carry the possibility of over a year in prison. So under federal law even though you were never convicted of a felony, you would still lose your gun rights because the potential sentence was over a year.
