I think he kicked the guys head and made a loud schwack when doing so. The guy was pretty much done when that happened. Boyfriend let her pound away, as he should have done.

Wow, impressively stupid. Didn’t he know that unauthorized crime in Vegas is severely punished? He is really lucky that the LVPD didn’t get him first.

I did a little searching, and the answer seems to be . . . it depends.
Largely, it depends upon the jurisdiction and the judicial interpretation of "deadly weapon."
Find Law: case law Tennessee Supreme Court Here is a case where the Tennessee Supreme Court sent a case back to the lower court, because it disagreed with the lower court's interpretation of the "Deadly Weapon" law as including feet. The judge writing the opinion absolutely disagrees that feet and hands may be considered deadly weapons and agrees the jury was incorrectly instructed.
Yahoo Answers: What is considered a deadly weapon in California? This answer, purportedly by a criminal defense attorney speaks to the issue of felonious assault: i.e. assault serious to be considered a felony not a misdemeanor.
He states there are some weapons immediately recognized as deadly, e.g. guns and knives. Use of one of these, even when force is not applied (i.e., using an empty gun to threaten or holding a knife to someones throat without causing damage) is felonious assault. In this case hands and feet are not ever held to be deadly weapons.
On the other hand, one may commit assault with deadly force which does not utilize a deadly weapon, but is still considered felony assault. Since he was NOT on the ground, large and able to resume attack no it was just. Its why the police keep shooting till there is no threat. He was still a threat at the point of the kick.
The only public places my family go are parks and the occasional mall. My Wife and I are always armed.
I strongly recommend to anyone who conceals carry that they also have a serious sheath knife that can be quick drawn.
Many of these type attacks happen well within Tueller Drill range, and the attackers use feints to get even closer, such as asking if you have a cigarette or a lighter, or other such ruse while walking towards you. Alternatively, they use a fly-by attack, so you have minimal time to evade or even recognize they are attacking you.
In either case, a knife is out quick, and in the 0-5 foot range. There is no hesitation in the draw, and if the blade is hidden behind the forearm, handle in hand, it is very discreet. You can draw it when they are half a block away and nobody will notice. You do not appear aggressive at all.
If they are outside the blade range and not approaching, then you have lots of flexibility about drawing your gun.
What’s really pathetic though is the white guy that comes to the rescue of the black perp and actually tried to comfort the scum. WTH? Have whites lost all sense of self preservation and community? If this had been a Hispanic mall everyone there would have piled on.
