Supreme Court must strike down Proposition 8 and DOMA

Over the next two days, the justices will consider two of the weightiest civil rights cases in years, both about the continuing struggle of gay men and lesbians to obtain equal recognition under the law. On Tuesday, the court will consider the constitutionality of Proposition 8, .... On Wednesday, the justices will turn to the Defense of Marriage Act (DOMA), a law enacted in 1996 that bars the federal government from offering benefits to same-sex couples, even if they were legally married in their home state.

The justices have many options as they consider how to rule. But more important than the particulars of their eventual holdings is the general direction they choose to take: They must move the country forward, not back.

.... A much more reasonable outcome than that would have the court point forward cautiously. .... But the justices can be expected to stop short of ruling so broadly that they would require every state to recognize same-sex marriage, when four-fifths of the states currently do not. .....

The progressive but incremental approach that these circuit courts, the Obama Justice Department, prominent attorneys and many others who would uphold gay rights have adopted represents an important phase in the evolution of legal thought on same-sex marriage. It cannot be satisfying to those of us who see a strong equal-protection case for same-sex equality. But, given concerns that a sweeping judicial mandate might cause a counterproductive backlash, it is understandable.

Gay-rights advocates are winning the argument. ..... Now, it seems not only possible but also likely that same-sex marriage will be legal, widespread and, frankly, mundane and that this will happen relatively soon. The Supreme Court must play a part in this civil rights triumph — and justices should not shrink from it.

After five decades of lies and disinformation?

Going up against the Pink Mafia is a nightmare. A dear friend was “outed” after significant material support on Prop. 8 by that rat of a judge who ruled that a private nonprofit must disclose its donors.

The Pink Mafia then went after him personally and worked to get him fired from his top executive position. There was an internal trial for his job in which he was literally sent through an inquisition to prove that he wasn’t a bigot because he supported marriage. He made kept his job, but it certainly made him leery this time around.

It’s sick and it’s mind control.

I am with you. BUT Conservative values have been taking a dive in 2012 - the perverts appearing to have won the public over, as most propaganda machines do over time. Remember the propagandists have been waging this perversion war for decades.

And a proposed MN state amendment to prohibit same sex marriage failed in the last election. But keep in mind, this is the same state that sends a buffoon & clown like Al Franken to the U.S. Senate (that election should have not even been close to begin with) and also sends a CAIR terrorist advocate, Keith Ellison, to the House of Representatives. AND we have crazy eyes, former Senator Mark Dayton, as our current MN state governor. I hate to admit it, but we as conservatives, patriots, pro-life, pro-traditional marriage of one man & one woman, are now decidedly in a minority position. God help us!

Except when it doesn't. Last year, it went 0-4. Lost every one. And nobody seriously thinks it would pass in California now.

We've lost that card, have to make a different argument. The will of the people is moving quickly in the wrong direction.

Latest news proves the SC is lacking any brains and it looks that the insane communists 9 circus court might stand and Prop 8, that the overwhelming California voters won, will be overturned and once again the communists of America won. America is finished.

I stopped reading right there. More propaganda from the MSM being presented as "news". Does the DNC draft all their articles for them? It certainly seems that way.

Despite official attempts to redefine it, it’s still a pathology so it’s no surprise - but still unpleasant - when other pathologies are also observed, such as uncontrollable temper, inability to speak or think rationally, incitement of mob rule, etc.

There’s precious little ‘pride’ on display. Instead, it’s the usual fascist bully-boy tactics.

If only I have your optimism.

CA people voted on it (Prop 8) twice.

Yet here we are, at the SC. And no gurantee the court will rule in the same principle as the one you pointed out.
