States don't want to set up an exchange? No problem, feds got a fee for that.

So much for stopping Obamacare by refusing to set up state exchanges. Obama administration will charge a 3.5% user fee on premiums in states where Feds have to create the exchange. The theory rested on the premise there was no funding mechanism in Obamacare for the federal exchanges. Read more.

The states oughta go passive-aggressive on the feds.

Set up exchanges that don't work.

Yet states that have set up a health care exchange are already predicting huge increases in the estimated costs within the first couple of years.

The heck with exchanges, states should start forming and training their own infantry regiments. A better return on investment.

All well and good, but a few little PROBLEMS remain for Big Brother: HHS has been given NO MONEY by congress to set up an exchange in any state which has refused to set up its own. So charging a fee is dandy, but where will the money LEGALLY come from to set up the fee charging exchange in the first place?
Secondly, states may sue the feds for trying to set up exchanges at all! The issue of the legality of running an ObamaCare exchange in an unwilling state is far from settled.

Did he even try to claim a legal justification for the fee, or he just pissed off about states passing this back to the federales so he can impose any fee he feels like?

Even better, set up a state exchange and charge a 3.5 user fee on the premiums to fund it.

The Feds are establishing and setting the administrative price for use of Obamacare.

Obamacare was ruled a tax and it came from the Senate, a clear violation of the Constitution. I’m waiting for that case (and it’s out there), to reach the Supreme Court.
