Who's sorry about the Roberts ruling now?

Any year now, Democrats may start to ask themselves if it might have been better had John Roberts not changed his mind. If they would be better off with Obamacare out of its and our misery, a bone of contention now safely buried, and not as a bone in their throats.

For one thing, they still have the issue upon them -- the historic triumph they don't dare mention but which Republicans happily do.

Second, were Obamacare no longer the law, we might be seeing an uptick in hiring right now. Instead, that will be deferred until after November (and then possibly only if Romney's elected), and unemployment is rising in 44 states. Unemployment rising in 44 states is not what you want when just ten or so states will decide the election and unemployment has been 8 percent or higher for 41 months.

Third, had Roberts done otherwise, they might still have the issue of Medicare, which at this point they do not. When Paul Ryan was chosen to run with Mitt Romney, liberals planned to rip him to pieces over plans to trim Medicare. Somehow, they forgot that their own health care plan did much the same thing, covering 30 million new clients by draining millions from providers of Medicare. Although these cuts will not directly lead Medicare clients to pay more or lose coverage, they will end with many doctors and hospitals refusing to treat them at all.

This move on Medicare, which began as a shield for Ryan to fend off attacks on his program, turned into a sword, as it started to drag Obamacare into the argument. As Josh Kraushaar noted in National Journal, "by having a conversation about Medicare, it allows them to bring up President Barack Obama's unpopular health care law as well." Bill Kristol thinks D-Day was Aug. 14, when it suddenly dawned on the people in Boston they could link their defense of Ryan's proposals to the public disgust with the president's plan. "Obamacare's unpopularity blunts Obama's attacks on Romney-Ryan Medicare plans," said a Miami Herald headline only days later. A Rasmussen Reports poll found that by a 54 percent to 42 percent split, seniors in Florida found Obamacare more frightening than the Ryan proposals. (The split among all ages was 48 percent to 41 percent.)

The National Republican Campaign Committee polled 28 battleground states on both Ryan's plan and the Democrats' message against it, and found Ryan winning by ten points on aggregate. As Kraushaar put it, "Obama's health care law is even more unpopular than his record on the economy."

And the Republicans found a way to bring that into the argument, too. The health care reform plan, with its massive menu of regulations and tax hikes, has long been seen by everyone except Obama and his fanatical followers as an anchor dragging the down the "recoveries" that haven't been happening. It seems that then public is onto this, too. "Rather than being seen as a diversion from talking about the economy, 43 percent believe repeal [of the bill] would help the economy," says Scott Rasmussen. "Just 27 percent think it would hurt. That's one of the reasons most voters consistently support repeal. It's not a choice between repealing the health care law and focusing on the economy. They're part of the same plan."

So Medicare, which is part of the looming entitlement crisis, is now feeding Romney's plans to fix the economy. For linking the two, Romney can thank Obama's health care reform plan, given to an ungrateful nation and rescued by the Supreme Court just in time to ruin its author.

Who's thanking John Roberts now?

I'm not holding my breath, but she makes some interesting points. Especially about the rope-a-dope on Medicare. Putting Ryan and his Medicare plan on the ticket might just turn out to be the shrewdest political move of the decade.

It is my opinion that Roberts was horribly compromised. It will come out. Compromise means blackmailed. It was the end of our country and I mean the end. He is directly to blame.

It could have played both ways. Obama-care may still cause Dems some problems now as 2010 but if Romney gets elected and is too scared to call for repeal of the popular give-a-way parts, or he does and there is backlash over it, it would look better if Roberts threw it out..

I was one of the lone few who was skeptical that it would be thrown out so I didnt go into a tizzy over it.

We’ll never know...and there are some good reasons to think that someone got to him.

Even so, perhaps he’s sending us a message to not expect him to do our dirty work. Thomas, Scalia, and Kennedy are getting old - if we keep electing clowns like Obama, they will NOT be able to keep waiting them out.

In other words, if we want to end Obamacare, then we need run candidates to that effect and TO VOTE that way, not rely on 3 geriatrics that will not be there much longer to protect us.

In the past, whenever the rats said “Boo” about Medicare, the GOP would scamper off and hide in the bushes with their tails between their legs. Those days are over because Romney/Ryan are pounding home the truth day after day...and the people are listening, especially the seniors.

Well, you might have something there but I personally attribute no good to the man at all. My opinion is he sold out because of fear like sniveling coward and he is despicably self absorbed afraid that his wife will find out the truth. I believe he is now in the bag forever for what ever the socialists want.That is my opinion. The Supreme Court is a total joke.

Roberts was hedging his position in history. He probably doesn’t really care one way or another very much about ObamaCare. He’s concerned more about his legacy: an activist court or a ‘balance’ court. If he voted like a conservative Justice would do, he’d be considered activist. So, he chosen to throw the decision to the American public via the presidential election. He expected this year election to be a referendum on Obama, and by association,on ObamaCare. Obama reelected, it means the public wants it. Obama defeated, the public doesn’t want it.

A judge should not make a ruling on a Constitutional question based on the political outcome of his decision.

The arguments presented remind me of those football fans who want to lose games in order to get a high draft pick for next year.

Changed his mind? This decision was nothing short of brilliant for the constitution and a near death blow for liberals and socialists everywhere..

How, you ask?

First, set aside the emotions, shut off the a.m. radio for a moment and put on your thinking cap. Think about how the libs have been pushing through their programs for over 80 years.

When the supreme court issues a ruling, there are 2 opinions written, the majority and the minority. Both opinions carry weight.

The majority opinion carries the majority of the weight, with the minority opinion carrying little weight, but carrying weight nontheless. The minority opinion can and has been used as a kind of “back door” for judicial activism for decades now.

The libs use 3 main “sledgehammers” to pass and keep passing their agenda.

Roberts took all 3 away.

He stated that the commerce clause cannot be used to create commerce in order to regulate it ( the most favorite tactic of the left )..

Now the brilliant part.. the minority opinion CONCURS!!! back door closed, sledgehammer taken away....

Roberts ruled that the Necessary and General clause cannot be used to create any damn social program that comes along ( his ruling was way more wordy than this, but this is the general idea )..

And the minority opinion CONCURS!!! back door closed, sledgehammer taken away....

and now I have saved the best for last (and this one is already being used)

Roberts ruled that the feds can no longer issue mandates to the states with financial penalties for non compliance. In other words, unfunded mandates by the feds to the states cannot happen.

I have heard of alot of people saying that Roberts is a traitor to the conservative movement. Roberts is not a conservative. He is a Federalist. He is a member of the Federalist society. He believes in the constitution.

This ruling restored more to the constitution than any other ruling in the past 80 years.

It has effectively destroyed the entire battle plan of the socialists in one big bold swoop.

and the minority opinion concurs....

Had Roberts gone with the other side, the minority opinion would more than likely have been written by that old bag ginsberg, and the libs battle plan could go on uninterrupted....

My guess is that the libs were so desperate to keep this thing that they were willing to do ANYTHING...

Roberts saw the opportunity and took it.

He hoodwinked the crap out of the socialists..

How do I know this?

Find and listen to that old bag ginsbergs comments after the ruling..

She was angry as hell, her voice dripping with both sarcasm and disgust..

That is enough proof for me that not only is this what happened, but that she knows the jig is up..

That is an interesting take on Roberts SC ruling that I have not seen before. To find an upside to Obamacare is hard for me to accept or understand in a free market, capitalist society. Thanks for posting this.

I appreciate your analysis--and I want to stand a cheer. It is easy to agree with your points--and I must admit I didn't get the Ginsberg thing right away after the ruling.

However, does it matter at all what the Supreme Court says and does in these days--someone above making the point that Republicans and Conservatives putting our destiny in the hands of a couple of geriatrics?

Here is why I ask: The Supreme Court ruled on Arizona's SB 1070, striking down most of it, but leaving the provision that ". . .requires an officer to make a reasonable attempt to determine the immigration status of a person stopped, detained or arrested if there's reasonable suspicion that person is in the country illegally." {Quote from the Arizona Republic.]

This week, a shrieking female attorney, Karen Tumlin of the National Immigration Law Center is back in federal court--in the court of one of Obama's favorite thug federal judges, Susan Bolton--screaming that a new injunction MUST be issued. And Susan Bolton, the federal judge, is considering it. Even, I think, looking for a way to issue the injunction.

So there it is: Supremes say one thing; Bolton the thug judge threatens to ignore them.

What think?

My feeling is a bird in the hand is worth a whole damn flock in the bush especially if you have Mitt Romney and John Boenher doing your shooting.

If that is in any way cryptic, I think it would have better if Roberts weren't a traitor slime and struck it down. Unless GOP wins big and exit polls reveal Osamacare was a huge reason why AND then they repeal it. Even then that can't be what Roberts was thinking about when that diarrhea came out of his pen.

If it was Kennedy I would have said "damn, oh well". But Kennedy wrote the great dissent and Roberts (who warning sign was coming off another bad decision) who we thought was on our side was the judas. That I think is responsible for the tizzying, not just that it was upheld.
