(Actually I'm an ex-smoker--more than three years now -- But I think about it every day.)
It will depend on whether there were any civilian dead, who they were, and whether the military defers to the U.S. Attorney in that district.
If he killed any of the civilian Dept. of the Army security personnel he would be looking at an aggravated federal murder charge, the same thing that got McVeigh a death penalty.
