Lawyer Breaks Contract to Represent Obama Accuser After Threats

Larry Sinclair, the man who accuses presumptive Democrat nominee Barack Obama of using hard drugs and participating in gay sex acts in 1999, is being refused representation by a Delaware lawyer despite Sinclair's ability to pay all legal fees and a written agreement. Sinclair claims that the attorney was fully and personally briefed on the explosive nature of the case.

A scant eight hours after Attorney Richard R. Wier, jr. agreed to represent Sinclair, for a retainer of $10,000.00, he backed out of the deal at 5:15 pm today stating: "I cannot represent you knowing that you are saying the things you are saying about Senator Barack Obama and the Bidens."

Larry Sinclair's statement here.

Mr. Weir was obviously referring to pressure he has received from Obama supporters and Senator Joe Biden, as well as Biden's son who is the Attorney General of the State of Delaware.

Many bloggers have implicated the Obama Campaign and the Bidens in the silencing of Mr. Sinclair.

Larry Sinclair needs to keep fighting the good fight all the way to November. I just hope that an Obama goon does not murder Sinclair over his statements.

One thing that I have noticed is that Obama's "stop the smear" site has completely left Sinclair off their list of denials.

My theory is that Obama knows Sinclair personally, but is trying to ignore him.

If Sinclair is telling lies, then why doesn't Obama's camp give their version of the story and let the voters decide?

I am going to go out on a limb and suggest the following:

Sinclair needs to carefully organize all of his facts and start pushing his story to the next level: Talk Radio.

He needs to maintain his support on the internet, and present his case about the lawyers avoiding him. He should also present his case about Obama's refusal to release the aforementioned 1999 schedule to the public.

Sinclair really needs to acknowledge that Obama's "stop the smears" site refuses to publish any evidence to discredit Sinclair's side of the story. Obama should also be asked if he has ever met Sinclair.

Now, some folks here might say that I am nuts for believing Sinclair.

However, I believe that people are shunning him in the official channels because they believe that Sinclair's story can seriously damage Obama.

It just adds credability to Sinclair. Best thing that could have happened especially with someone with such a great reputation as this lawyer who signs then backs out of agreements.

Exactly. Lawyers can’t file lawsuits they know or believe to have no basis in law or fact. They can’t knowingly put a fraud before the courts. So this lawyer, faced with a client with a long history of being a con man, is unlikely to be comfortable with these allegations without some supporting evidence. I haven’t followed this case closely, but I haven’t heard anything other than innuendo or conspiracy. Allegstions of these sorts require corroboration.

Maybe he is and maybe it is a feint, maybe both. And if Sinclair is telling the truth, there is nothing to say that he will not deny it later.

Sinclair will have to make his own case until it ‘gets legs’.

As another poster suggested, talk radio is an avenue for him.

You have to read Sinclair statements carefully. After all he IS a conman. He didn't pay the retainer, he says that "he could". Sinclair was arrested in Delaware for paying for hotel stays with fake money orders. He just said he lost is disability payments on another release. If the retainer hasn't been paid, then he doesn't have a contract with Sinclair for representation. Even if he did, there would be an escape clause.

The lawyer wants paid and he knows that he would probably be left holding the bag for his hourly fees.

You make some excellent points.

Why did Weir even look at the case if it was made clear there were no corroborating witnesses available?

It's really Sinclair Vs. Obama if the limo driver doesn't testify.

Having watched Obama dance with Ellen Degeneres on the internet video clip and the video of him at the bowling alley, I believe that Obama's non-verbal cues demonstrate his closet homosexuality.

Again, how can I consider disbelieving Sinclair if Obama's handlers refuse to issue a statement on the "stop the smears" website? They launched the stupid thing to address "rumors" on the internet, yet make no reference to one of the larger allegations out there.

Obama still has not publicly denied knowing Sinclair, either.

The reality is we will not see any major excitement until the convention in Denver.

Between the rumored "whitey" tape and the Sinclair allegations, I believe Hillary's agents will clear the air come August.

She has no chance at the White House if she doesn't stop Obama at the convention.

Talk Radio is an avenue for him because it will absolutely be "sink or swim" time for this story.

Most of the radio hosts and their staffers will put Sinclair's case under a microscope before he even gets to the microphone.

Everything will be carefully examined and inspected for errors/loopholes/deception. The mystery surrounding the Chicago PD and Sprint phone records will hopefully be analyzed as well.

I keep in mind that both of these organizations are telling very different stories about Sinclair's phone records claim.

If his stuff adds up, then he might actually make it to the interview. After that, the sky is the limit.

while Weir likely would not be disbarred, he certainly should be reported to the Attorney Registration and Disciplinary Commission of Delaware. He will then have to justify what he did, possibly in writing first, and then with an in-person appearance and hearing before the Commission if his reasoning is not satisfactory.

The idea of contacting the ACLU is also good if necessary, as well as Manning and friendly radio stations such as Rense and Limbaugh, and all the standard news folks we all watch, especially all those converted attorneys over at Fox.

That lawyer signed the document - read it.

Sinclair should sue him for double his rate 1000 bucks an hour 24k a day.

A contract involves offer, acceptance, AND CONSIDERATION. There is no consideration without money changing hands. That is what a retainer is for.

Why doesn’t Sinclair just get another attorney if he has the cash?

So? These documents have consideration clauses and escape clauses. This is another non-story. Besides, you only have a convicted fraud's word that it was signed. This is Sinclairs way of getting guys like you worked up and donating.

Again, why not just get another lawyer?

What the lawyer signed was probably an engagement letter, which typically is signed at the outset of a relationship and describes the relationship. They usually have language that say something to the extent that either party can terminate the relationship at any time upon notice.

Signing a contract that says you can terminate the contract at any time and then terminating that contract seems pretty reasonable to me.

Up until know I’ve been very dubious about Sinclair’s allegations concerning Obama. However, if Obama’s people are threatening Sinclair’s lawyer to get him to drop the representation, it gives new credence to Sinclair’s allegations.

Larry Sinclair entered into an agreement with Richard R Wier, Jr, former Attorney General of Delaware, for legal representation. Mr. Sinclair is to be arraigned in Superior Court in delaware today, Thursday, July 3, 2008. Mr. Sinclair was notified at 5:15 PM, Wednesday, July 2, 2008 that Mr. Weir would not be representing him. According to Mr. Sinclair, this is the reason given by Mr. Weir:

“I cannot represent you knowing that you are saying the things you are saying about Senator Barack Obama and the Bidens.”

Larry has appeared, signed in, shown his work and efforts, and explained the Wier matter from yesterday. His case appearance has been postponed for a few weeks. Larry has said he will have an update later.

I would doubt that what appears there is the only agreement between the two. Nevertheless, I’m still not really seeing a problem here, particularly because it’s hard to see how Sinclair is harmed.

Sinclair has gathered a very few disciples that will support him to the end. They wonder why Obambi doesn't mention it on his smear site. The answer is they only answer smears that the have to. Rush and Hannity and Savage and Beck are too smart to do more than mention this guy in passing because he isn't credible at all. That doesn't mean he isn't telling the truth, it just means he has to put up or shut up.

I think he did this for money. He has lied for money many times before. I bet he's surprised that no one in the Obama campaign was willing to pay to make him go away, and even more surprised when guys like pissant donate to pay for his meals.

As long as the shark did not accept the money, then I figure he is free to back out. He’s not going to get in any trouble over it, especially since he is the former AG. LS is going to have to find another shark to represent him. He may have been sandbagged by this lawyer, but I don’t even think it worthwhile to file a complaint.

I have never seen or heard the M&N show. I found an article on the web that a DJ had contacted a family member of one of the alleged murder victims, Nate Spencer, and the DJ was told that Nate wasn't murdered but died from a long illness. It also said the family member was certain of this because he was holding his hand when he died.

I don't know if it is true, but you and none of the other Sinclair lovers have produced any evidence that Nate was murdered and I can't find any.

Well, for not seeing it or hearing of it, you managed to post a link to it and have their talking points down pretty well.

And why do you keep bringing up Nate Spencer to me? Take your beef up with the bloggers who are making that argument. I don’t know anything about Nate Spencer other than he was a member of Obama’s church. I don’t know if he was ill, if he was murdered, or if he’s running a beauty parlor in Palo Alto.
