Laurence Tribe explains why Congress should aim to work at three speeds.

On this week’s Amicus, Dahlia Lithwick spoke to Laurence Tribe, professor of constitutional law at Harvard, about some of the legal questions the impeachment inquiry into President Donald Trump’s behavior has brought up. A portion of that conversation, which has been lightly edited and condensed for clarity, is below.

Dahlia Lithwick: We’ve had quite anxious listener mail this week saying, what does Congress do? What teeth can Congress put into a system where essentially the nihilist argument has been made—“I spit on your system, your system does not bind me”? Is it in fact the case that [Congress will do] things that have not been done since the Teapot Dome scandal? Is it the case that we’re going to start jailing Hope Hicks, that we’re going to put Corey Lewandowski in the stocks, we’re going to fine people? Is that power? Is that the teeth that Congress has?

Laurence Tribe: Well, a lot of people, I think, would have a lovely time imagining those perp walks, but I think that’s not a realistic option. It’s legal. It’s a power that Congress has. It theoretically has the power. The Supreme Court has, without dissent, affirmed it—the power to actually conduct a little trial of people who refuse to comply with subpoenas and orders to show up and produce documents. And if they don’t go along, they can be locked in the basement of the Capitol or they can be subjected to escalating fines.

But I think that would be a terrible distraction. Imagine in the modern world how that would look. It would really make the banana republic that the president has created look like sort of a banana soup republic. It’s just not a good idea.

Tribe is moron. More wrong than right. I think Trump should temporarily suspend the Constitution, arrest all Democraps,and members of the media. Charge them with conspiracy and offer them exile, stripped of their American Citizenship with no chance of returning, or instant death. When they choose exile, send them all to Haiti.when they refuse, put them in a wood chipper. Once gone, we’ll return to normal and Trump reinstates the constitution back to normal.

Look at their agenda and who embraces it. They’re burning mad in their lust for power and long term authoritarian control. Everything they propose either takes away personal freedoms, or gives you a one-size-fits-all answer for all your ills, all funded by money that isn’t theirs or ours, or ain’t there to begin with and never will be. They think that every failed Leftist regime in history that collapsed and destroyed countries and peoples can be fixed up with a little coat of new paint and some slick social media sloganeering. As usual, their ideas are abhorrent to right-thinking people, so they roll out the usual coalition of single issue groups to try to ram it down everyone’s throats - race grievance militants, illegal immigration warriors, various factions of faggots, global whiners and other EcoNazi types, socially-engineered milennials and Generation Zero types programmed by public ed-u-ma-cation institutions, and flat-out airheads who couldn’t pour piss out of a boot if the instructions were on the heel. Half of them couldn’t exist without some sort of government subsidy, and the other half live communally, like rats or cockroaches. The very cream of Homo Sapiens.

Sounds like a great plan - except that last part might need a bit more detailed explanation. I do not believe things would ever return to normal. And we are very far from normal already. In fact, the new "normal" looks a lot like the old "awful".

This is simply tiresome. Pretending that Trump is somehow lawless while condoning Hillary’s open contempt of the entire legal system and the Democrats’ outrageous abuse of the FISA system and due process with respect to the impeachment is just too achingly hypocritical for belief. “It’s a country of laws, not of men” pretty much sinks in the face of the addition “And we’re the law.”
