Seattle woman in viral video arrested for criminal trespassing, not refusing to wear a mask, police say

BOTHELL, Wash.—An unidentified woman who is seen on video struggling with an officer was arrested in a grocery store for criminal trespassing, not violating the statewide mask mandate, Bothell police said in response to a viral video which has drawn strong reactions on social media.

But the man who recorded and published the video claims the woman’s arrest was political and heavy-handed, because the woman claimed to have a medical exemption to the state mask mandate.

The video shows a woman--who had been participating in a rally protesting lockdown restrictions like the mask mandate--resisting being handcuffed while being arrested (snip)

“We have not arrested any person, at any time, for ‘not wearing a mask.’ The person in this video was being taken into custody for Criminal Trespassing,” a blotter post read.

Dustin Barnes of Everett, who recorded the confrontation, said the woman was singled out because she refused to wear a mask in the store because of a medical condition. “I don’t think the cops should be enforcing a store’s corporate policy on taxpayers dollars,” Barnes said.(snip)

Police say employees reported that there were 10 people inside the store who refused face coverings after being asked to put one on, and being offered free masks

Barnes, who has a disability rating as a former Army Ranger which exempts him from the state mask rule, said he had not met the woman before, but agreed to accompany her inside the store to buy a bottle of water.

“Nobody from the store approached her,” Barnes said. “The first person to make contact with her was the police officer you see on the tape. I didn’t hear him read her rights, why she was being arrested, or what she was doing. All I heard him say was ‘stop resisting’ over and over again.”'

I think it would all depend on the signage. If there’s a sign on the store’s front door that says “you must wear a mask to enter”, then put on a mask or go shop somewhere else. Maybe order what you need online.

I’m a big believer in property rights. So it really doesn’t matter what that sign might say, as long as it doesn’t violate federal law. So if a store wants to put up a sign that says “you must wear a cowboy hat to enter”, then put on a cowboy hat or go shop somewhere else. I think that’s fully consistent with conservative thought.

But if there was no sign, I’m on the lady’s side.

Those rags they are making their employees wear are not OSHA approved. Where is osha, why haven't we heard from them? They should be having a field day here!

Everyone in Washington state knows that statewide we have been ordered to wear masks in every public place. It has been months and months since our would-be king governor ordered this mandate.

Former Vice President Joe Biden is promising that, if elected, he would urge state and local governments to issue mask mandates nationwide.

The Democrat nominee, who has shifted on his support for a federal mask mandate, told supporters in Delaware on Friday that it was vital for the government to implement a “national strategy to position our country to finally get ahead of this virus.”

As part of the strategy, the former vice president promised not only to get a spending bill, that deals with both the economic and public safety aspects of the novel coronavirus, through Congress by January, but also to push for comprehensive mask mandates.

“I’ll go to every governor and urge them to mandate mask-wearing in their states,” he said. “If they refuse I’ll go to the mayors and county executives and get local masking requirements in place nationwide.”

Biden added that his administration would “mandate mask-wearing in all federal buildings and all interstate transportation” since “masks” have been proven to “save lives.”

It’s the same in my state. We have a Democrat king-governor too. I totally ignore him and his buffoonish secretary of health. As I noted earlier, I believe in property rights. So I will obey the signs on the store’s door.

But it’s surprising how many stores simply ignore what our imperial governor has decreed. If the store has no signage, then I just do what I personally think is best.

If the store is very crowded, yeah, I wear a mask. Otherwise, no mask.

And it will never end because tyrants love power. I don’t believe that the executive branches can mandate masks indefinitely without approval from the legislative branches. The balance of power thing.

It’s actually a tough call. Some businesses really think they are protecting their employees by demanding that everyone wear a mask. I cannot fault such businesses.

Other businesses are teetering on the edge of bankruptcy. And they are afraid they will be shut down if they defy the governor’s orders. I cannot fault these businesses either.

It’s a real mess. I really don’t know what the answer is. All I know is that Trump is the best person to lead us out of this. If Biden gets elected...as my grandmother would say, “Oh, my.”

This is honestly why I am not a blue lives matter fan. The police are agents of the government, no matter how corrupt, not the People. I do like my sheriff. They is OK.

Some (many?) businesses live in fear of what the governors might do if they don’t comply with the mandates. Licenses will be stripped, fines imposed and doors boarded up. Dread the day when the health department shows up to shut them down and board up their doors. This happened to businesses that refused to comply.

Sorry, but you are wrong. No matter what the store sign says, not wearing a mask to go into the store cannot be construed as trespassing. If, as the woman alleges, she has a medical condition that precludes her from wearing a mask, then the Americans with Disabilities Act takes precedence over the store owners’ desire to discriminate against people not wearing masks. The FEDERAL CIVIL RIGHT not to be discriminated against due to a disability is inviolate.

I know. I have just such a disability to wear a mask. My blood oxygen saturation level is already low, running between 88% to 91%, not in the level where I need to be on daytime oxygen supplement, but do have to have it at night as it can drop to as low as 81%. Wearing a mask makes it drop into the dangerous to my life level. I cannot wear a mask. I do not have to reveal what my disability is due to HIPPA regulations, I just have to assert my disability.

The police officer should have known of this exemption to any such requirement and so should the operators of that store. To not allow it would be the same as preventing persons in wheel chairs, on crutches, or the mentally impaired from entering the store. Many people look healthy, but are not.

I try to avoid entering places were masks are required, but occasionally I have to. Most have been understanding about my problem.

You have to wonder about the store itself. PCC Markets are located in liberal neighborhoods all over the Puget Sound area.

I had the misfortune of shopping there ONE time. It was about 15 years ago. MY wife and 3 of our kids went into the store in the Green Lake area. My oldest child was was 6 and the other two kids were in a double stroller. My wife was expecting our 4th at the time. We went through the store, and not once did any of the kids scream, cry, or make any kind of fuss or disruption.

However, we seemed to be getting death stares from everyone in the store, not just the shoppers, but the store staff as well. It turns out that the problem was the kids....we’re not supposed to have so many. Not that it was a rule, but these people thought we were contributing to the destruction of the planet because we had more than one child.

Needless to say, we never went back there ever again and we would NEVER recommend them to anyone.

The fact that someone freaked out over the maskless woman doesn’t surprise me at all.

I must respectfully disagree. Property rights trump all in my book. If an owner wants you trespassed, then you are trespassed. A police officer on his own cannot do that. But a property owner can.

You do make a point with the ‘Americans with Disabilities Act’. As a disabled person myself, I am quite sensitive to such issues. But suppose a person might have a very contagious disease. And because of a disability, that person cannot wear a mask. That disability should not exempt the person from a store’s safety rules!

Unfortunately, most federal judges would probably disagree with me.

And most state judges. A store owner, manager, etc., would be facing personal civil rights violation suits for forcing the issue. It’s happened already. Most wise ones don’t push the case. They may have the power to do it, but they don’t have the right to do so. It’s discriminatory and they will get rolled up and squashed.

A retail store has been ruled a place of public accommodation for this purpose, they are not private. They cannot discriminate due to disabilities. They cannot pick and choose their customers based on whims of their own choosing. . . Even health department mask mandates when there are exemptions in the law, and every state has such exemptions for those who are medically unable to wear masks.

Store owners, Mayors, city councils, health departments, homeowners and condo associations, and police cannot ignore the law to impose their lessor authority to prohibit people who are medically disabled from having access that non-disables people can access without being wrung out to dry for abusing the rights of their abusee.

Property rights do not trump all things. There are reasonable use restrictions especially when they are open to the public.
