In-N-Out Takes Aussie Burger Chain To Court

In-N-Out is taking Australian burger chain “Down N’ Out” to federal court, claiming the business is mimicking its offerings and misleading customers hungry for American-style burgers.

The Sydney Morning Herald reports the famous California burger chain first took Hashtag Burgers to court last October. Hashtag Burgers has two Down N’ Out restaurants in Sydney and in a northwest city called Ryde.

In-N-Out alleges the Australian chain is seeking to “mimic or model” its business and has similar offerings, including a “secret” menu, according to the Herald.

I chuckle at people who compare the tasteless nothing Whattaburger to the IN N OUT burger. IN N OUT with a worldwide reputation of unmatched quality and taste being compared to a tasteless burger of the month called the Whattaburger that nobody outside Texas has ever heard about.

IN N OUT. The same menu for like what........60 years now. At Whattaburger...they got something new every week it seems. I guess you have to when your original is that crappy.

There are no In-N-Out restaurants in Australia, but the chain says it has advertised there since 2012 and held pop-up restaurants.

The owners of Down N’ Out says that since In-N-Out doesn’t have a restaurant in Australia, there’s nothing for it to protect.

I guess I see both sides in this one.

Why advertise in a country where you do not have a franchise?

I see protecting your brand. You may one day open a franchise there.

If you are not competing why bother with a lawsuit. It seems a waste of money and effort.

If In-N-Out is so good, why are they afraid of a little competition?

I lived in CA for a number of years. In-N-Out is ok, but they don’t have a monopoly on good burgers.

There are trial lawyers who shop these kind of infringement suits to companies (for a piece of the action).

Did anyone think that Mission tortillas was connected to Mission Burrito (now Uburrito). Waiting for the lawsuit from Uber.

You are kidding me right? I like Whataburgers but it doesnt even compare to IN N Out.

I can WALK in at lunch time at any WB joint anytime. TRY doing that at In N Out in L.A...ANY Socal joint and you will be standing and parked in your car for hours.

And I chuckle at people who fawn over the overrated In-N-Out Burger. Now here in the Portland loony bin we have Killer Burger, which is just that.....Killer Burgers. But even Five Guys is superior to In-N-Out Burger. Just my taste buds talking, and everyone has their own preferences.

I first ate at Whataburger back in the 70s in Tallahassee FL, so they are known outside of Texas. I still eat at one occasionally and they are ok. I ate at an In-N-Out in San Francisco one time and it was good, but I still like Five Guys burgers a little better.

Have not had a In-n-Out burger in years.....Used to work in Tulsa some...and had some What-a-Burger a couple times...They are both fine....

But...have a little one place burger joint near me...called Okie Burgers. They make GREAT burgers....!!
