Technical Legal Question: How would it work if WJC is arrested?

Posted on 10/23/2016 8:20:12 AM PDT by Be Careful

If, for example, the Lolita Express videos appear this week re WJC, and some theoretical state agency e.g. Florida, elected to arrest him on the spot........does his security detail have to stand down so that the arrest can occur in order that he be taken in to custody?

Since he is a private citizen, how would that work?

In 1963 the Secret Service and Dallas police faced off with guns drawn over the body of JFK in Parkland Hospital. The coroner informed the Feds that the body had to remain there for an autopsy, and the Feds were just as adamant that no one other then handpicked personnel was going to probe the corpse. Despite there being no federal law to give anyone in the U.S. Government jurisdiction over investigating the assassination, the local authorities backed down in the interests of avoiding further conflict and a potential shootout between the various fiefs of different government agencies.

I not a conspiracy theorist so forget that angle but this incident does illustrate what would happen. Unless a stand down order came through, the SS would protect Clinton. Legalities and other pesky details go out the window when the rich and powerful are involved. Just ask the current FBI director.

The ultimate Arkancide, indeed.

That would be her best solution. Then she could rule the throne without the spectacle of future bimbo eruptions.

The Clintons are not only above the law, they are very close to becoming the law.

Well said! In the old days, the press would be the last line of defense against this sort of thing. Now the press is just an arm of the Clinton campaign.

As example #1, a senior Clinton operative, George Stephanopoulos, is now "Chief Political Correspondent" for ABC News. That should outrage everyone who believes in a free press. Journalism professors should be writing letters of protest.

But except for a few Deplorables, no one cares.

Although all individuals have the same rights and obligations, this principle is overlooked when it comes to the ruling elite, which is not held to the same standard as normal people. WJC will never be arrested or prosecuted.

The truth is that both the RINO Republican leadership and the Democrats have agreed on the principal that the “president is above the law.” And this applies to former presidents as well.

They probably rationalize this by saying that the POTUS could pardon anyone, including himself, for federal offenses, of any kind, while in office, so it is assumed that he has issued a “pocket pardon” to himself, his wife, and some, but not all, others in his administration.

And they do not want to start a “war” by allowing a new president of the other party to prosecute the old president.

And because the states are also partisan, the Secret Service will not permit the arrest of a former president, because “they are above state law, as well.”

There is a peculiar twist to this, however. While the SCOTUS has found that the federal courts are superior to state courts; and that congress is superior to state legislatures; they have *never* found that the POTUS is superior to state governors.

This means that when the two are at loggerheads, the impasse can only be broken if the POTUS sends in the US Army, as Eisenhower did against Bill Clinton’s mentor, governor Orval Faubus of Arkansas, to force the integration of Little Rock High School.

So, in turn, if Bill Clinton did something horrific *in a state*, the governor *could* order his arrest, and only the sitting POTUS could order in the Army, that is, if he wanted to.

Well, she would still have her own to deal with.

If it occurred in a US territory, like the US Virgin Islands, it would most likely be a federal indictment. Secret Service would detain and transfer custody to the FBI.

The DOJ would give him plenty of fair warning that an indictment was coming down. You know, in time to destroy any other evidence.

Hey, its a family thing..

Good analysis. My first question is always jurisdiction. Where did this happen?

You said what I have been reluctant to say for a couple of months now. What does she have left but a ploy for sympathy and him out of the way.

One of my neighbors years ago, when I lived in Garland, was one of the cops present at that stand off. He said it was a close moment and he figured he was dead right there.

Clintons refuse to accept Subpoenas with the SS present. Who thinks they are going to make an actual arrest?

Imagine what she will be able to do to her perceived enemies or opponents...

While liberals pretend to be concerned about governmental abuses of privacy rights and due process, they are working to set a terrible precedent here, one which could allow a witch hunt to be conducted anytime anywhere by bringing a person in for questioning under any false pretense.

Prosecutor: "Mr. Citizen, we're here to discuss comments attributed to you on social media sites. I'd like to ask you about November 22, the day the President was shot?"

Joe Citizen: "Do you mean President Kennedy? I wasn't born until 1969."

Pros: "We'll let's put that aside. Have you ever taken an illegal substance?"

Joe: "What has that got to do with..."

Pros: "Isn't it true that you've taken copier paper home from work hidden in your brief case."

Joe: "I don't see how..."

Pros: "Please tell the jury how many times you have driven home after cocktails, knowing full well that the legal limit is .08%"

Joe: "I don't have to..."

Pros: "... and didn't you falsify your IRS return by stating that..."

Joe:" I want a lawyer"

Pros: "Why do you need a lawyer?" (to the jury) "Isn't it clear that Mr. Citizen is NOT TELLING THE TRUTH HERE?" - "What is it you are hiding from the people, Mr. Citizen? Do you know that deceiving a grand jury is a FELONY OFFENSE?"

Joe: "But, I'm not..."

Pros: " OH REALLY? Let me ask you if at anytime in your life you've ever mentioned, or even thought about ...ever even considered harming someone of another race or gender --- THINK CAREFULLY, MR. CITIZEN - YOU’RE UNDER OATH!"

Hillary could arrange for Bill’s arrest. That would solve a lot of her problems.

Based on observations by someone who treated aids patients back when most wouldn’t, Bill only has a year or so of above ground antics. Unless, of course the Clintonistas pull out all the stops and go for the sympathy vote before November 8th.

I wouldn’t be surprised if he dies because the Clintonistas know Hillary is losing. From here on out they will get more desperate.

They would need a valid warrant for his arrest.

I am sure the agents would not let him out of their site, therefore it would likely be arranged. He would be out on bail in about five minutes.

The anonymous video that talks about the sex video of Bill Clinton does not say that the sex tape will be released. It only says that the tape exists. Anonymous makes no claim to be in possession of it either.
