Debate swirls around unarmed black man’s actions prior to fatal police shooting in Tulsa
Washington post ^ | September 20, 2016 | Peter Holley, Wesley Lowery and Derek Hawkins

A day after police in Oklahoma released video that shows a white Tulsa police officer fatally shooting an unarmed black man, attorneys representing the slain man’s family released photos that they said contradict a key claim in authorities’ version of events.

At a news conference Tuesday afternoon, Benjamin Crump — a civil rights lawyer who has represented many families of those killed in high-profile police shootings — said Terence Crutcher never reached his hands into the driver’s side window of his stalled sport-utility vehicle before he was shot by police.

Crutcher couldn’t have reached into the vehicle, Crump said, because enhanced photos of the vehicle taken from police video show that the window was rolled up.

If confirmed by police, the admission would eliminate one of the chief justifications for police using deadly force against Crutcher.

If I could see the video well and those officers could not then those officers need bloody glasses.

No, the officers probably could not see as well as you could because they were seeing things with normal eyes in real time twenty minutes after sunset. You are looking at the scene with enhanced video that increases the lighting.

there’s just a split second between “not a threat” and dead cop.

There is also just a split second between “not a threat” and dead innocent guy in the wrong place and wrong time...If this was a drunk vs someone possibly on PCP, would you still just pop him for acting drunk?

I am not saying it was a bad shoot...not enough info...but police need to get back to a place where they understand some risk is involved in the job, and removing that risk by just shooting first is not acceptable. If you want to serve society, great, I am all behind you. Been there myself. But if you think its ok to just shoot everything that raises your anxiety level, you have no business in the business.

“But don’t police have a responsibility to ensure that Crutcher represented a threat to their safety or the safety of others before they shot him? Isn’t that the threshold for using deadly force? Where was the threat?”

No, they do not, nor does anyone, because it is a practical impossibility.

The standard is: would a reasonable person in that situation perceive a deadly threat? It is the perception of the officer in that situation, knowing what they knew at the time, that is what matters.

Me too. I drive 150 miles a day. I also have a dash cam.

But to be fair, I see all races acting up on the road...

I carry in my car now because of this.

I wonder why they didn’t taze him before he could get back to his car.

I am afraid that one of the officers thought the had their tazer on him and when they fired realized it was their duty firearm.

Its happened several times before.

Your exaggeration sounds exactly like a lib. She is innocent until proven guilty which means she is allowed a fair trial. She may have made a mistake, but how easy is it for you to sit in your armchair and judge then become a lynch mob.

Why aren’t you supporting the guy with the “book” yesterday? Just because they now have a gun there is no reason for you not to lynch that cop too.

Certainly the extent to which he failed to comply with orders was not helpful to his chances of surviving the encounter, and I think that’s a fair point to bring up in any situation like this as a message to others who might find themselves in similar situations. That said, failing to comply with a police order is not a crime punishable by death, and in this case, it seems nearly certain that had she kept the gun in her holster, he would’ve been tased and controlled without further incident. Tragic and unfortunate. Whether there’s criminal liability of some sort, hard to say.

I am trying my best to withhold judgment until we have some more facts. I think it's pretty clear he was on something. According to the first 911 call made by another motorist, he was acting nutty and is described to be “smoking something”. That doesn't mean he deserved to die. I'm betting that Officer Shelby is distraught, and wishes she could take that moment back. She can't. I hate this for his family, and for Tulsa. To make things worse, Al Sharpton is coming and getting involved, so this will officially be turned into a circus. We will be lucky if we don't have riots.

The cops tasered him a few times and it did nothing as he was likely on PCP which was found in his car. Other articles describe taser use, 8 outstanding warrants, erract behavior

That key point seems to be lost on many who say "if he only obeyed the police orders..."

The law in many states requires that anyone using deadly force believe that their is an imminent threat to their safety or that of others. (And yes, I am intentionally omitting some more unusual circumstances, like arson, which exist in some states.)

Just refusing to obey the orders of another person, law enforcement officer or civilian, isn't justification for the use of deadly force.

When the cops have guns drawn and are screaming get on the ground, it's probably a better idea to comply than to ignore them and stroll back to your car.

Usually

But not always.

...."because enhanced photos of the vehicle taken from police video show that the window was rolled up.".....

No, it doesn't. There is no tint on the drivers window. It's down. They are claiming the seat belt is blood running down. He would have had to be shot in the head to get that running down from the roof. I'm getting a little sick of FR lately. It seem the trolls have taken over.

I feel sometimes I'm reading Huffpo rather than FR.

They zigzag in and out of traffic. They drive on the shoulder to avoid backed up traffic. They use their vehicles to intimidate others. They overtly throw litter out their windows in full view of others.

Sounds like typical driving for white guys in pickup trucks too - I've seen it with my own eyes in Texas.

You may be right and we will not know the whole story until after the cop is lynched and town burned. We all make mistakes it is just when a cop makes a mistake it can cause death. This guy is not at fault.

You would think this cop shot him in the head while he was in handcuffs.

I have sat here and watched another video of it over and over. Don’t know what was wrong with the man but he was out of it.

He had his hands up then walks over to the car. This is my best guess everyone. He walked to the car and put both his hands on it kind of like the way you see them do it on that TV show COPS before they put the cuffs on you. That is what I suspect he was trying to do but his mind was mess up. I do hear a male cop yell something about him being tazed then I hear the female one yell “shots fired”. Only thing is he fired no shots, she did.

Okay he was not violent so why did they have to shoot him? If they did have to shoot him why to kill him? Why not in the arm or leg?

Then I want you all to notice after they shot him all of them walk back from like like he freaking Jason Vorhees and going get up and start killing all of them, yet like I said he was not violent. This was not like that case in LA years ago, what’s his name? Rodney King? This man was not attacking them.

Drunks can kill you, too. If the drunk is coherent enough to actively disobey instructions and try to evade or escape, one does what needs to be done according to SOP.

I agree with you about the risks. I hate to see cops shoot people when non-lethal-force (tazer, bean-bag rounds, etc.) would suffice.

But people in the “at risk” class, who are most likely to get shot by the police, have to understand the risks of what they choose to do, too.
