George Harrison's estate: Trump's use of 'Here Comes the Sun' is 'offensive'
Entertainment Weekly ^ | 7/22/15 | Jessica Goodman

The Beatles’ beloved Abbey Road song “Here Comes the Sun” was played at the 2016 Republican National Convention Thursday as Ivanka Trump took the stage, and late Thursday night, George Harrison’s estate slammed Republican nominee Donald Trump for using the song, calling the act “offensive” and “against the wishes of the George Harrison estate.” (Harrison wrote the track.)

“The unauthorized use of #HereComestheSun at the #RNCinCLE is offensive & against the wishes of the George Harrison estate,” Harrison’s estate’s official Twitter account posted.

The account then followed up and joked that maybe another one of Harrison’s songs would have better suited the Republican National Convention: “If it had been Beware of Darkness, then we MAY have approved it! #TrumpYourself.” (“Beware of Darkness” appears on Harrison’s solo album All Things Must Pass.)

The Beatles sold their rights to that song. They should make it their theme song just to piss them off.

I don`t know why any one would want to use a

Maybe there is some wierd ones in the Trump staff.

In spite of what the article says, my own ears tell me it was not the Beatles' version of Here Comes the Sun that played last night, but instead a version by the cover band.

That wouldn't matter, because the rights are with the author of the song, or whoever they sold it to.

However, if one's song is licences with ASCAP or BMI, and someone pays the royalty, can you really cherrypick who can use it?

They're right. They should have played "Here Comes the Daughter".

My understanding is the Beatles lost ownership of their music many years ago.

Then Trump needed to get permission from the owner, Michael Jackson's estate.

I imagine that old George did a lot of drugs, and for whatever reason, most or even almost all performing artists lean very far left.

Almost all the music I like is performed by left wing maggots, but seeing how much I love music, if someone makes music that I like, they get a pass on being an idiot.

I don’t offer the same leeway for actors though.

I never was a big Beatles fan though. They got a couple of good songs, but I don’t care for most of them.

I think it is totally wrong what Trump did. I think to make it right, every cover band will have to pay royalties to the artist or the families every time they play a song that isn’t theirs. The bar or venue can collect the money from the band and after taxes send it to the appropriate people.

Nothing there legally. This is just a group of lefties speaking out for one purpose, so their lefty friends know they didn't "sell out". Now they can go back and crawl into their safe space.

That is how it appeared to me. If they had a legal issue, a lawyer would have responded. Since all they did was tweet a complaint, it appeared they didn't have any legal standing.

It already is. Breathing means you exhale carbon dioxide, something rabid liberals hate but know nothing about.

Pretty sure the song rights are still owned by the Harrison estate. Unlikely that an estate prohibits political use. Estates just want the money. Doubtful the Trump campaign skipped any legalities. If they did, someone needs to be fired, as political use of music has a long history of controversy.

Olivia and Dhani need to stuff it. It’s hilarious watching these liberals get all ticked off when conservatives use their music. A little organization called ASCAP essentially requires all musicians to license their songs through them for commercial resale. It’s basically the musician’s union. As long as Trump is paying the licensing fees there’s not a damn thing that Olivia and Dhani can do about it. And George was my favorite Beatle by the way.

Not fair use, but the Trump campaign paid all necessary fees in advance.

Harrison’s estate would have to pay the same fees if they wanted to use the music in a commercial setting, as the rights were sold years ago, they have zero say in use today.

LOL!

I think my father’s estate would join your father’s in this. Perhaps they are talking about this together right now.

Almost none of the artists or after market owners directly license the music. It’s almost always done through a group like ASCAP. That said, I don’t know if use by political campaigns and conventions is considered fair use or is done by license. Either way, the leftist artists who spout off about conservatives using their music really don’t have a say in it.

I've read something that appeared official on FR already addressing this complaint yesterday. There is no legal issue here.

Theoretically there is but not one worth pursuing. Even if Trump or the Quicken Arena had a deal with ASCA or whoever, political events are exempted. So technically Trump's campaign illegally used the song but the owners of the music, Michael Jackson's heirs, would be the ones to sue and not Harrison's heirs. And the damages from a one time use would be so minuscule that legal actions would be a waste of time. So Trump used it, Harrison's family acted all outraged, Trump won't use it again, and it's a dead issue.

As long as Trump pays for the use of the song he can use is without anyone’s permission. I suppose the irony of George having written “Taxman” is lost on George’s “estate”.

The problem is — the song is too “dark”?
