Can Texas legally secede from the United States?

Hey, Texplainer: Britain voted to leave the European Union. Can Texas secede from the United States?

In the wake of Britain’s historic vote to leave the European Union - nicknamed "Brexit" - speculation of a Texit on the horizon have cropped up once again. The secessionist movement has a long history in the Lone Star state. Delegates for the Texas Republican Party even recently debated adding secessionist language to the party's platform. But is it actually legal for Texas to leave the United States?

Simply put, the answer is no. Historical and legal precedents make it clear that Texas could not pull off a Texit - at least not legally.

The US Constitution is silent on the issue of secession.

No.

The only way for any state to leave the US is via Secession and armed conflict.

Or a rewrite of the USC via Constitutional Convention which provides for exit.

Yes, I do recall hearing my uncle say something about that years ago when we were visiting him in Texas. As you said, prior to joining the Union Texas was a sovereign nation and had the option of secession incorporated into their statehood documents.

Of course it can. Any of the states can legally secede from the union.

Successfully resisting the inevitable military attempt to return the state to the union is another matter, however.

Prior to becoming a state Texas was an independent nation. An agreement between two or more independent nations is a treaty. Under international law any party to a treaty can nullify/withdraw from that treaty. So yes Texas, under international law recognized by the USA, can secede.

The thirteen original colonies might be able to make a similar but much less convincing argument.

Why? Just print the money and give it to them. The easiest would be electronically, which we seem to have been doing.

The federal reserve notes are backed up by nothing but the U.S. government’s ability to print them or create them out of thin air.

What we learned from the Civil war was that unilateral secession is impermissible. No one has tried yet for a negotiated secession.

Yes As with Every State! (Not Just Texas) The Constitution was Nothing but a Contract of the different States, Thus Contract can be broke, end... For what is a State? It is the People that Make a State, The State may try as it might, but it does not make the people...

Logic dictates, as well as History, for the premise of the question is what lead to the Original 13 States to begin with... Their Right to Form and Dissolve the bands with one another...

Wrong. The US Constitution is silent on the issue. The last session was orderly and followed state conventions. The war came because the North acted in a fascist manner. Secession does not mean war. Only a fascist thinks like that.

Of course they can.

States created fedgov. They can leave.

Doesnt mean fedgov will accept it, but they sure the hell can.
