Christopher Johnson was arrested on July 29, 2015, on the suspicion that he was driving while intoxicated, the lawsuit filed Wednesday states. When he was posing for his mugshot, he was allegedly choked by two Harris County employees while being booked into the county jail because he was smiling for the photo. The lawsuit does not specify who the two employees were or what their jobs were.
“It was a willful violation of his civil rights and civil liberties, he should have the right to smile,” Andre Evans, Johnson’s attorney, told ABC News Friday. Evans hopes to “send a message that as attorneys we hear that the rumors about what takes place in the jail and type of treatment that they receive from the jail officers, and we are sending a message that that is not allowed.”
He added: “We do hope for some reform in the jail policies and procedures, and more clarity.”
While posing for what he says were approximately ten photographs, Johnson claims he was choked by the two Harris County employees for approximately 30 seconds, the lawsuit states. “This is how I always take my pictures,” Johnson said to the booking officer, according to the lawsuit.

At what BAC level is a driver drunk? 0.15%? (that’s what the AMA stipulated when the whole DUI thing got legs).
After several years, the public got the message, DUI charges dropped considerably, so what did the gov’t do? Lowered the impaired level to 0.10%. Lo and behold, suddenly there was a spike in the DUI arrests, showing the sheeple just how unsafe the roads were.
Once again, people reduced their drinking before getting behind the wheel, and DUI arrests fell off. Guess what happened next? 0.08% and yet another huge spike in DUI arrests. That is tapering off, so what is the solution?
Now they want to drop the BAC to 0.05% (they already have in some jurisdictions in Canada).
At the latest level, a 175 pound man is over the limit if TWO drinks are consumed in an hour. Does that sound like a drunkard/impaired driver to you?
The whole DUI thing has little or nothing to do with road safety anymore, it has become a monstrous cash cow for the government, lawyers and police. The MADD propaganda certainly has worked well on a lot of otherwise smart people.

I have run countless DUI wrecks over the years.
I cannot recall one where the guy ended up testing 0.10 or even 0.15. It is always 0.2 or 0.3.

If that guy has a 8% of his blood consist of pure alcohol, then, yes. Jail him for years and revoke any future PRIVILEGE of driving, and perhaps that should get the message to all drunkards that attempt to kill people every time they drive. Repeat offenders should just be put away.
Did you even read what I wrote? The BAC level I was referring to was 0.05%. Look again.
BTW, even the hardest core drinker would be DEAD DEAD DEAD at 0.6% BAC, let alone 8%. Most people would be dead at 0.45%, but that level would be difficult to attain simply because they would go into an alcohol-induced coma by the time they hit 0.35%.

You don’t know, do you? BAC of 0.45 is 45%. The legal limit of BAC 0.08 is 8%. So, 8% of your blood is pure alcohol. That is the legal limit. Know basic math.

Look VERY CAREFULLY at the numbers I posted. You will notice there is a little thing call a decimal point AND a percentage sign.
0.08% is 1/100 of 8%.
Perhaps you can explain to me how two 12 ounce bottles of beer at 5% alcohol by volume (that’s 1.2 ounces of pure alcohol btw) can cause the blood alcohol level of a 175 lb man with a total blood volume of approximately 6 quarts to go from 0% to 8%?

The body starts metabolizing alcohol the moment it reaches the liver, causing the BAC to drop immediately.
@ sagar - I think you are confusing .08 as a decimal of 1 with .08%.
.08 as a decimal of 1 converts to 8% but .08% equals .0008 as a decimal. When citing BAC’s the % sign is often omitted but implied as it is always expressed as a percentage of blood volume.
A person whose blood is, even if they could physically reach that level, at 8% would be long dead, basically embalmed.
A BAC of 0.250-0.399% = Alcohol poisoning. Loss of consciousness. A BAC of 0.40% + (or .004 expressed as a decimal) = Onset of coma, possible death due to respiratory arrest.
Blood alcohol content is usually expressed as a percentage of ethanol in the blood in units of mass of alcohol per volume of blood or mass of alcohol per mass of blood, depending on the country. For instance, in North America a BAC of 0.1 (0.1% or one tenth of one percent) means that there are 0.10 g of alcohol for every dL of blood.
