Woman Proves Her Body Brews Alcohol To Beat DUI Charges

Drink driving charges against a woman in New York have been dismissed after it was revealed she suffers from auto-brewery syndrome - a rare digestive condition that turns food into alcohol.

The 35-year-old teacher was pulled over in New York last October after police received reports her Toyota Carolla was "weaving all over" the road. When pulled over and tested, she recorded a blood-alcohol level of more than four times the legal limit at 0.33%.

Police alleged that she failed several field sobriety tests, including standing on one foot and talking and turning heel-to-toe - but the woman, who has not been named, insisted she had consumed no more than three drinks in the six hours before she was pulled over.

Her lawyer, Joseph Marusak arranged to have medical professionals monitor his client for a day to ensure she did not consume alcohol and to take several blood samples for testing.

She also bought a breath test kit and blew into it every night for 18 days, registering around 0.20% every time.

After several assessments, the woman was diagnosed with auto-brewery syndrome, and was prescribed a low-carbohydrate diet that brought her symptoms under control.

Marusak told Buffalo News: "She can register a blood alcohol content that would have you or I falling down drunk, but she can function."

Her case was dismissed, leaving her free to drive without restrictions, however prosecutors are seeking to have the charges against the woman reinstated.

At this point in time I could not walk a straight line. It’s a pain thing that doesn’t prevent me from driving but from being able to walk straight unassisted. I use a shopping cart to buy one or two items. Hope I am never asked to prove my sobriety in that fashion.

The field sobriety tests are not designed so that you can pass them easily.

cop pulls up behind a couple of fellas drinking and driving- the driver says “Quick, take the labels off the bottles and stick them to your forehead”

The cop pulls them over, walks up to the car and says “Have you fellas been drinking”?

The driver says “Nope- No siree- not us- (points to the label stuck to his forehead and continues) See? We’re on the patch

How can she drive if She’s drunk? The alcohol must be making her drunk?

I personally passed one at 4am after a very long wedding party, even though I wasn’t even in a car, or on a public road. I know it’s hard to believe, but the officer tried to get me to say that I met him on the road, although I was pulled into a pasture and no one was in the car when he rolled by.

It didn’t work.

alcohol impairs driving abilities regardless of the source. sounds to me that she has a medical condition that precludes her from operating a motor vehicle or machinery

That’s a disease I never heard of. I suppose she has to be very careful what she eats, knowing most carbs can serve as a basis for making alcohol.

I get that she should have this DUI dismissed, but she should also lose her license due to her medical condition, like people with other conditions like epilepsy that cannot be controlled via medication.

The article says that with a restricted diet, she does not produce alcohol therefore they could not suspend her license. That said, with new knowledge aforethought, if she gets stopped again and registers drunk, she could be convicted.

Only if her medical condition is not under control / being treated. Low carb diet plus meds can control this condition. In some ways similar to a diabetic. As long as their blood sugars are under control, they can drive.
