I know MLB shows a disclaimer on the big screen, and announces that bats and balls can be a hazard. IF I was the restaurant owner, I’d put a humorous, but pointed sign saying beware of thrown rolls. Keeps the litigious types at bay.

Tough to say. I think the woman has no more of a case than someone who gets hit by an errant foul ball at a baseball game or a flying piece of tire at an auto race. In a sane society, anyway . . .

Both of you got it wrong. Lambert's is just good country cooking, served liberally. The rolls are fresh, soft, and buttery warm delights. I'm wondering if this woman has to hire somebody to chew her food for her.

I was dubious, then read the amount that she is trying to recover. The $25K seems in line with her alleged injuries. I’d wager that the restaurant’s insurance will pick it up.

Good resource you pointed to, there. I didn’t know how many other injuries had occurred to ip other customers, the woman’s requirement for skin grafts, or the paltry offer McDonalds had made to her for her injuries.

The article doesn’t mention that the coffee was intentionally so hot to reduce free refills, however.

Certainly agree that FR is a unique site on the entire WWW for discussion, hot topics, knowledge and friendship.

I wondered about that myself. I’m not a doctor either, but I am a lawyer who started his career in insurance defense. If Lambert’s is found liable, a possible pre-existing condition won’t matter. Under our tort system, generally speaking, a wrongdoer must take his victim as he is found. This is an old principle of law that is sometimes called the “Eggshell Skull Rule” and it is applicable in strict liability, negligence, and intentional tort cases.

I go to restaurants where they respect the food and the customers and don’t throw it around like a college cafeteria. Why the gimmick? The food has to be lousy if they need it to draw in customers.

Yes. How many other customers at that McDonald's in particular complained about the hot coffee? How many cups did that McDonald's sell in a day, every day, around the time this occurred. Certainly they would have lost customers if the coffee was too hot. 700 complaints against the entirety of the McDonald's total coffee sales over 11 years is not even statistical noise.
