Lauderdale Co. inmate sues sheriff for right to have abortion

LAUDERDALE COUNTY, AL (WAFF) -

An inmate in the Lauderdale County jail filed a federal lawsuit against the Lauderdale County sheriff after she says she was denied the right to get an abortion while she is in jail.

In court documents filed Monday with the U.S. District Court, the inmate, referred to as Jane Doe, says a woman has a "fundamental right to decide whether or not to bear a child" and that the right continues even after incarceration.

In court paperwork, Doe said she was pregnant prior to being jailed and attempted to have an abortion before she was put in jail. When she was admitted to the jail, she received a pregnancy test, which confirmed the pregnancy and requested access to an abortion at that time. The lawsuit says Doe's request for either a medical furlough or supervised transportation to an abortion clinic was denied.

I am completely against abortion, but I think this woman has a good case. As long as it is legal she should be able to avail herself of it, as much as she would be permitted any other medical care.

We are giving inmates heart transplants and sex change operations after all.

Oh flame me, go ahead.

It’s like I came on FR tonight just to say obnoxious things....what’s up with that?

I agree with the sheriff.

If she had wanted an abortion she should not have been arrested to begin with. More than likely she just wants the county to pay for her baby.

She could demand to get her tubes tied. Or even a vasectomy.

Do her teeth need fixing? Is she going bald? Perhaps her small boobs are giving her a complex.

Didn’t she already make the decision when she spread her legs?

It doesn’t say she was raped, so it looks like she made her choice, now she wants someone else to kill the child she made.

The County Jail's policy of treating non-emergency medical needs in-house, and transporting only for emergencies, is fully justified.

Pregnancy is not an injury. It is not a disease. It is not a disability. It is not a medical emergency. It does not require medical treatment.

The treatment she proposes, disables a normal physiological process. Disabling of normal processes is not therapeutic. And it intentionally causes death: but death is not a treatment. Death is what ethical medicine is supposed to prevent.

And the State has no interest in causing infant death.

That may or may not be true, but most pregnant women nowadays get regular medical care and I don’t think anyone would encourage a pregnant woman NOT to see a doctor.

I’m opposed to abortion and I would urge this woman not to have one but the fact of the matter is that if she did not have an abortion she would still need regular checkups during her pregnancy.

I’m sure this woman will prevail in her suit and if she does not she’s almost certain to prevail in the violation of her civil rights suit that she will file later.

Regular check-ups would certainly be a good thing, and they could, I presume, be provided by the staff at the County institution.

The legal and political system are so corrupt I'm sure any sort of pro-abortion lawsuit would prevail. Nevertheless, it would not be because genuine concern for her real welfare or her real right; it is only because of the decayed state of law and justice.
