Home schooling was focus of Child Protection investigation, N.J. family says

BELVIDERE—A Warren County family is suing the state's Division of Child Protection and Permanency for alleged unconstitutional home intrusion and civil rights violations.

Christopher Zimmer and his wife Nicole, of Belvidere, filed a civil rights complaint in United States District Court in Trenton yesterday against DCP&P, a DCP&P supervisor and one of its case workers for an alleged "unlawful and unconstitutional home intrusion of their home."

"I won't forget that morning for a long, long time," said Mr. Zimmer, thinking back to a Tuesday morning in January that began with a caseworker pounding on their door. ....

Mr. Zimmer said that the caseworker demanded she be let inside, adding that the family did not have a choice. Startled by her aggression, Mr. Zimmer questioned why she was there.

The Zimmers allege that the caseworker refused to answer the question, until later admitting that the homeschooling of 15-year-old Christopher Zimmer, Jr. was the focus of her investigation.

Not knowing the extent of his rights, Mr. Zimmer called town police to sort out the matter, but police ultimately said the caseworker was allowed to come into the house.

At that point, the family made a decision more out of fear than logic.

Mr. Zimmer let the woman inside their home, attempting to prove he had nothing to hide, but after two hours of questioning that the family describes as interrogation, it became clear that this would not end quickly.

"My fear was, if I didn't let her in the house, if I had closed the door and didn't let her in the house then the police would be knocking at the door and think I'm hiding something," he said.

The questions started out simple, asking about home life and happiness, but Mr. Zimmer said the questions soon became invasive and pointed, ...

Focusing on what the Zimmers believe was a tip about "improper homeschooling" filed confidentially by a juvenile known to their son, the caseworker asked to see records of attendance, textbooks and test scores.

I'd like to know if this is true or some made up lie to justify their heavy handed investigation

That’s why you call your lawyer first. They fear lawyers, they love the idea of getting to use a SWAT team to subdue a “terrorist” homeschooling family.

Lawyer should be able to get a good publicist working on the case immediately if necessary.

They don’t like to be seen publicly as the wicked ones they are, or getting slapped by a judge for going way overboard.

Politicians have elections to think about.

Suing for millions. They won’t get a penny and will lose a lot of dollars.
Child “protectors” are given great latitude for the sake of the children. “If it saves one child” is a slogan that trumps the Constitution.
This is simply the way things are now. Any jackass can accuse you of anything, and if you have a child, that’s all the foot in the door the authorities need.
In this case, no property was seized, no dog was shot, no parent was handcuffed and no child kidnapped, and even if ALL that happened they’d have a tough time proving it wasn’t diligent, benevolent, child lovin’ white horse ridin’ righteousness.
Homeschooled & been there.

In this case, family with military background, Warren County (rural), this sounds like a completely bogus case, sounds like the family is 100% legitimate.

The DYFS crowd are an illegitimate mob of punks.

Letting them into your house is mistake.

Let no one intrude on your property.

Best to be in with your local government and have your local police escort immediately such people off your property.

In this case, they were not tight with local police and local government.

I think in many cases local government is now simply new world order minions. They need to be unelected and replaced with local boys, decent people.

There should be private security contractors that will remove such unwelcome parties. This should be a growth industry - security services for good decent Americans, available all over. Handle government intrusions or other criminals. Should team up with local law firms for marketing / sales references.

Show up with a few ex-military in good shape loaded for bear with a high powered lawyer standing with them.

Americans harassed is a business opportunity for those who can fix the situation.

This is why the wealthy hire their own security.

No reason why everyone can’t hire such security on a short-term, job-by-job basis.

Would only cost a couple hundred dollars, and financing could be provided.

The government punks that assault families without a warrant know that they are doing something highly illegal.

DYFS needs to be put out of business permanently.

They don't really care about your fire power either, since they have a great deal more of it than you do, not to mention more committed manpower. I say the answer is defunding. They're not very good at funding themselves. They need taxpayers for that. It's all they need. And you're there for them.

But, if you withhold it, they'll take away your freedom. So keep on paying the protection racket and maybe they'll never get around to you at all.

They got around to me once and since then I have understood the difference between freedom and luck.

I believe DYFS was attacked for the sace I mentioned, and pulled out the usual excuses (too many cases per worker, etc.); the dead child was discovered when authorities became involved due to children scavenging food from garbage cans. One of the malnourished children mentioned having another brother in the past, and the body was discovered in a plastic tub of some sort tucked away. Beyond the whole inquisition tactics about guns in homes, the government doesn’t know how to account for urban welfare bastards bred for cash; they certainly are raised in circumstances that would never be permitted for taxpayers’ children (and when the tactics used for the former are applied to the latter, there is a lot of friction). Urban public schools today serve the same purpose military service did nearly a century ago (and in some areas still does today) - an attempt at socialization of people on the fringes.

Their lesson plan needs to include how to shoot trespassers attempting to invade your home. There is no other reason to homeschool if it doesn't include such. May as well send your kid to Government School without that training as part of the syllabus.

Side Note - Warren County is still mostly agricultural and Republican. Many TEA Party people there.

HSLDA usually won't help once a contact has been made, if the family isn't members already. But they've been known to come in late anyway.

I would have called a lawyer and denied them entrance in the meantime, no matter WHAT they said. And police can't be counted on to know anything about law, so don't go by them, ever.

They only lost a few thousands kids a few years back.

IIRC, those were non-existent kids for whom criminal scammers were claiming benefits. They suddenly disappeared when policy changed and their existence had to be confirmed.

Friends of ours were called before the Texas CPS when her mother called CPS to complain about her daughter's home schooling the grandkids.

That fact that the mom called from Terrell State Hospital, a local low security state mental hospital, made no difference.
