South Carolina police shooting defense: What the video doesn't show

The video appears to be damning: a white police officer fatally shooting a black man in the back as he ran away.

The shooting of Walter Scott by North Charleston, S.C., police Officer Thomas Stager has generated national outrage. Stager has been fired and charged with murder.

Legal and police tactics experts said the video would be powerful evidence in the criminal case. But they say it still leaves Stager’s defense with options.

One likely defense focus will be what is not on the video. The interaction between Scott and Stager before the shooting is not seen, nor is the traffic stop that began the incident. Defense attorneys will probably push on this, the experts said, telling jurors that the video doesn’t tell the whole story.

“What was the conversation and interaction between the officer and the subject?” said retired Los Angeles police Capt. Greg Meyer. “Why did the subject run away?”

Yes, exactly. Cops are usually lousy shots, so I was surprised he hit the target. I guess he’s done this before...

That guy would have died in the same way — if he’d been white.

Nothing would have changed.

A very good and important point.

Cops nowadays seem to have little regard for anybody, whether black, white, or purple.

They can, literally, get away with murder, and that influences their behavior.

I'll be amazed if this officer is convicted even in a supposedly cut-and-dried case like this...

Remember that the police had a routine cop shooting on Saturday, and they did read the reports, and everything was normal, until Monday, when they received this video.

They then charged the cop with murder.

Under the circumstances, it is ironic that you use “Innocent until proven guilty”, for the representative of the law who was videotaped conducting the murder of someone that he judged, and murdered, and then appears to have planted a weapon on.

When it comes to "us vs. them" mentality, many here & elsewhere think they are viewed as "us" by their government & law enforcement when, in reality, they are viewed as "them".

I’m very pro law enforcement. I have been on the side of the cops in every single one of these recent matters, even in the Eric Garner matter.

I can’t see any way in which this officer could claim that his life was in imminent danger at the time he discharged his weapon.

I am still open to hearing his side of the story, but at this point I think he is where he needs to be, and I do think he needs to be facing charges. I also feel very sorry for his pregnant wife and his victim.

Something was dropped by the driver. If it was a tazer, it will be obvious how far the driver fled after dropping it by the amount of wire spooled out.

Give the investigators a chance to do their job, Holder is already on it, it is no linger local or regional investigators.

I'm sure this guy was an upright citizen, perhaps going to his church to meet about adopting an orphan, then headed for a "vote for honesty" rally with the mayor, and then stopping for flowers for his wife. Minding his own business, driving along to a drug drop (oops) and happened to smile at a very mean cop. Sure, bob.

No, you're sure that he deserved to be executed in cold blood, and that any questioning of that murder should be mocked.

You're not new, you know. There have been millions like you down through history. Your thinking is well understood.

I know more about this than you have posted. I have seen the video, and fully agree with the arrest. I am interested in what is presented as evidence in the upcoming trial.
