Cop charged with murder of motorist after jarring video surfaces

CHARLESTON, S.C. — A white South Carolina police officer has been charged with murder in the shooting death of a black motorist after a traffic stop. North Charleston Mayor Keith Summey told a hastily called news conference that city Patrolman Michael Thomas Slager was arrested and charged Tuesday after law enforcement officials saw a video of the shooting following a Saturday traffic stop. Authorities say the victim, 50-year-old Walter Lamer Scott of Charleston, was shot after the officer already hit him with a stun gun.

But, they don’t think they are. And that is the main problem.

When a person who has “put you in fear of your life” has his back toward you and is 50 feet away running away from you fast, the imminent danger to you is over. The video shows that was the case here. That cop was in no danger.

Don’t try this yourself if you have a carry permit. Or,
even if you dont. You will be charged with murder too. Just like this assassin was.

Sometimes it does, sometimes it doesn't.

This is what Tennessee v. Garner, 471 U.S. 1 (1985) says, in part ...

Thus, if ... there is probable cause to believe that he has committed a crime involving the infliction or threatened infliction of serious physical harm, deadly force may be used if necessary to prevent escape, and if, where feasible, some warning has been given.
But this sort of justification does not apply when the shooter is a civilian.

I appreciated your citation that showed the term "imminent threat" was broader than most might interpret.

Of course, on FR, knee-jerk reactions are always occurring, and, if knee-jerking were an Olympic sport, FReepers would always be atop the podium.

Did he have his hands up? Did he follow the repeated order to stop? We know that the order from training was issued like a reflex. He was bad enough to run from a cop, so we know he could have been a danger to someone.

[Only poking fun at so many other arguments about recent occurrences.]

If you watch the video you can see a black item on the ground that the shootee drops just before he starts running away. It could be the taser. However, the guy isn’t running that fast and the cop could have chased him down. But the cop fired eight times and the guy fell to the ground. The idiot recording the scene needs some lessons in using his camera phone.

The first thing that glares at me makes me not want to read the article. They couldn’t go anymore out of the way to make it a White on Black case. If it was the other way around then no mention of color would be made.

Okay, hole_n_one, answer this: the video shows the cop planting the weapon on the victim. Please explain how that was legitimate and justified, and not what the video clearly shows: a cop guilty of shooting an unarmed man in the back planting a weapon on the body.

Cops are allowed more reasons for using deadly force than we mere civilians. Not saying the shooting was justified, just saying that cops don’t need to perceive any imminent threat to themselves or others in order to justify use of deadly force.

All of these videos seem to start that way. They only start rolling after the fight has ended. It’s like a sixth sense with these people.
