German judge: Man can't be fined for peeing standing up

DUSSELDORF, Germany, - A German judge ruled a tenant can't be held responsible for floor damage resulting from urinating while in the standing position.

Dusseldorf Judge Stefan Hank sided with the tenant, whose lawsuit said the landlord refused to return $2,100 of his $3,300 deposit, alleging the resident's urine had damaged the marble floor around the toilet.

Hank said the arguments from the landlord and a "technical expert" who confirmed urine was responsible for the marble tile damage were "credible and understandable," but not enough to sway his opinion.

"Despite the increasing domestication of men in this regard, urinating while standing up is still widespread," the judge wrote in his ruling.

Hank said the landlord should have warned the tenant of the floor's "sensitivity" to urine droplets.

"Anyone who still practices this formerly dominant custom has to expect occasional clashes with -- especially female -- flatmates. But they don't have to worry about corrosion to the marble floor," Hank wrote.

There has been a growing movement in Germany to convert "Stehpinkler," men who stand while urinating, into tidier "Sitzpinkler," men who sit to pee. Opponents of the movement sometimes use "Sitzpinkler" as a derogatory term to insult a man's masculinity.

The tenant didn’t clean the floor, so it got damaged. Doesn’t matter what his peeing position was. It’s irrelevant. It’s his responsibility to maintain the premises. He should pay for fixing the floor.

Off topic a little, but not really . . . I had a wonderful, faithful, protective, SMART & loyal Sheltie a few years ago ( “Flash” ). After rigorous potty/house training as a pup , she began barking and raisin’ all kinds of hell every time she wondered into the bathroom as I was “recluberating my plubis” ( takin’ a leak ) standing up. Later after MUCH hellraisin’, it came to me that Flash was training ME not to tinkle in the house. As long as she lived ( about 11 years ) , I had to pee sitting down or face her music ! ! I sure do love and miss her - she was a good girl !

I remember when they were putting carpet in bathrooms, it is disgusting when you see a bathroom today that still has 1970s carpeting in it.

LOL! My grandson, age 3, almost does it that way. He squats down on the seat, pants off, dangling his junk over almost perpendicular to the bowl and has far better aim than most adults.

Agreed.

I just don’t understand how a marbled floor would be damaged by pee, unless there was quite a bit of it and it seeped into crevices. It almost seems that this fellow was deliberately peeing on the floor.

I find this interesting partly because I am at that age where peeing is becoming a bit more of an adventure.

I am leading an American movement to make urinals, in addition to the standard toilet, standard features in bathrooms in American residences.

It is not men who need to change their custom of standing when peeing, but builders of housing that need to change their custom of not installing urinals in bathrooms.

If urinals were not better, and cleaner, with respect to men peeing, they would not exist. But they do exist because they meet the standard that meets the most convenient way for men to pee - standing up, and it meets that standard with a device that makes the process cleaner.

Urinals should be in bathrooms in every residence. No where should men be expected to change their custom because the proper facilities for men have not been provided.

Well, duh. He should've just said is was due to urinating on the floor. Whether he sits or stands is irrelevant to the damage, but apparently relevant to the legality. But if he only mentioned the peeing on the floor, the judge wouldn't have had to rule on the standing part.
