A Huntsville man doomed by his own testimony, according to his lawyer, was convicted today of raping a woman passed out in the bathroom during a Fourth of July party last year.
Jason Scott McNeal, 36, was convicted of first-degree rape - having sex with a person unable to consent because they were physically helpless or mentally incapacitated - after the jury deliberated for more than two hours.
McNeal's father testified on his son's behalf, telling jurors the younger McNeal was not a violent person. But his claim was likely undermined for the jury after McNeal's father admitted on cross-examination that his son had shot him in 2001.
Madison County Assistant District Attorney Tim Gann said the victim in the case didn't remember much of the incident, which occurred during a Fourth of July block party on O'Fallon Drive in Huntsville in 2013.
She had too much to drink, Gann said, and went to a nearby house because she wasn't feeling well. She went into the bathroom and threw up, then passed out on the bathroom floor, Gann said.
A friend of hers came by looking for her a little while later, according to testimony, and she saw through the partially opened door that the victim was passed out in a pool of vomit and McNeal was having sex with her.

Sounds like he was aware, which is why he didn't want to call his client. But, unlike most tactical decisions in a trial (which are the lawyer's call), a criminal defendant can insist on taking the stand over his lawyer's objection.

It’s ultimately the client’s call. You can advise them not to, but if they want to tell their story, you have to let them. Using the father does, however, suggest a certain lack of preparation.
I get the sense that everyone feels that this thread is best read without pictures.
Cosby’s rapes are far more numerous and are current news, even breaking news.
