Union, Prosecutor Team to Push Papa John’s to Pay More

A union operative generously praised New York Attorney General Eric Schneiderman when he announced he was taking a Papa John’s pizza franchisee to court on behalf of workers who claim they were underpaid. The state attorney general, like the unions, called it “wage theft.”

The thing is, the union official knew about the government’s lawsuit before the pizza franchise did.

“Fast-food workers all across the city and country are organizing for higher pay and union rights,” said Kendall Fells, organizing director for Fast Food Forward, a group dedicated to increasing wages and benefits for fast-food workers. Fells added:

"This suit shows why their campaign is so important. And it shows that Attorney General Schneiderman is serious about holding fast-food companies accountable for wage theft."

Fells’ comments came in a press release from Schneiderman’s office announcing the lawsuit.

That means Fells, also on the payroll of the Service Employees International Union, knew New York’s attorney general was going after the Papa John’s franchisee before its owner, Ronald Johnson, did.

The suit, filed Oct. 16 in New York Supreme Court in Manhattan, seeks more than $2 million for more than 400 delivery workers in restitution, damages and interest from New Majority Holdings LLC, operator of five Papa John’s restaurants in Manhattan.

To some, this smacks of cronyism and calls into question the nature of the relationship between government officials such as Schneiderman, a Democrat who took office in 2011, and “worker centers” such as Fast Food Forward that are backed by the Service Employees International Union, or SEIU.

Why is this relationship surprising? It’s common knowledge that the unions and the Democrats have been in bed together for years.

Papa John’s should just close down their locations in New York. I’m sure they can thrive in states that don’t have this nonsense.

I do not know if this particular case was extortion. But if the franchises did not pay minimum wage, overtime, and vehicle expense reimbursements as charged and as the law required, shame on them. I support business in the battle against the evil union thugs, but I want our side to be accountable if they are abusing employees. Let’s fight the battle without giving them ammunition.

I don't know about his politics either. But as a businessman, it would make sense for him to flee the communist state of New York while he still can. I expect at some point King Obama will issue an edict making exorbitant minimum wages the law of the land.

Respectfully, the problem is, they are going after the franchisee - a local guy, not the corporation. Sure, it would be a great idea, but first, this guy has to pull up roots from NY, and then go figure out where he can go, and make a profit, in an area not already served by another franchise.

I despise actual ‘wage theft’, but this smacks of extortion. Thanks.

Respectfully, that sounds like a good idea, except anti trust laws would, at the very least, cause them to be fined out of business, with a possible prison term, thrown in.

It is no joke, in the airports, it used to be if two separate corporation bosses accidentally ran into each other, they would immediately head in opposite directions, lest there be an accusation of collusion. Thanks
