At heart: "The proposed policy provides a general framework for exercising enforcement discretion in individual cases, rather than establishing an absolute, inflexible policy of not enforcing the immigration laws in certain categories of cases. Given that the resources Congress has allocated to DHS are sufficient to remove only a small fraction of the total population of undocumented aliens in the United States, setting forth written guidance about how resources should presumptively be allocated in particular cases is a reasonable means of ensuring that DHS’s severely limited resources are systematically directed to its highest priorities across a large and diverse agency, as well as ensuring consistency in the administration of the removal system... "

Bippity,boppity, boo - Obama can try to justify his move however he wants, but I think Andrew Napolitano on Fox tonight explained as well as I’ve heard why what he’s doing is unconstitutional - in addition to the unprecedented numbers of those involved, he can’t impose conditions on their staying - paying a fine, paying back taxes and the rest - that’s setting conditions on their being allowed to stay which is tantamount to making laws which is outside his authority - it’ll never stand up in court.....

De-fund the issuance of visas..... Especially the diversity lottery and all other programs which allow immigration on basis other than skills/potential contribution to US. Then re-direct the funds to deportation AND incarceration awaiting deportation of those who entered illegally. Family re-unification will be done in the country of origin not the US.

From this point on, We the People should understand the rule of law is now in the same category as situational ethics. Likewise, those who believe they’re protected by these laws may find themselves longing for the days of We the People respecting the rule of law.

The Congress can, as part of the regulat budget, earmark funds for the border states to build and man a wall as part of a “shovel ready” jobs program. In this way the governors of the border states can direct the construction and defense of their states without fed interference.

Executive orders:

1. Unlimited use of such power? Does President Obama, and any future president, have unlimited use of executive orders?

2. For instance, can President Obama legally sign another executive order in, say, six months, where he again legalizes another 2,000,000 to 5,000,000 illegals, and nobody can do anything about it?

3. Doe it also mean that President Obama, in anther year November 2015, sign again another executive order legalizing other illegals, or bring in 2,000,000 to 5,000,000 people from, say, war-torn Iraq and Syria?

4. My point is this: Does all this executive order mess concerning immigration have an "enough is enough" stopping point, or will Obama and future presidents have the legal right to use executive orders to bring non-citizens into the United States as long and as often as they want?

5.God help us if Obama can legally sign immigration executive orders as often as he wants these last two years of his term, because he claims and makes the excuse that Congress is not doing its job when it come to immigration reform.

Posted this in ‘chat’ so it would be available to the few who want to slog through it (knowing most won’t).

At heart the lawyer says Obama can do this because he doesn’t have enough money to enforce the law.
Simple solution: give him enough!
The appropriators can do that now and the Dems can’t stop them.

But, of course that isn’t what the Chamber of Commerce wants the Republicans to do.
