**vanity** American Community Survey - Do I have to fill this out?

Today I received "The American Community Survey" from the Commerce Dept. It is 28pp of very intrusive questions, from the time I usually leave for work (to the minute) to who I work for and how much I make to how much I pay for utilities, and much, much more. The questions are repeated for everyone who lives in my household and include name, address, and phone numbers.

It says I am required by law to return this.

Anyone here familiar with this? Any advice?

Nobody has ever been prosecuted for not filling out a census form. If you’re prepared to be firm, you will be bothered for a few months, and then they’ll go away.

“While big business benefits from having as much information about citizens as possible, many citizens are unwilling to give away their right to privacy. Hence, many are refusing to return the ACS. This automatically results in an additional form being sent, followed by a series of phone calls. In 21% of the cases, an unannounced, personal visit from a Census Bureau representative follows in a final attempt to get the survey completed. Often, more than one visit takes place.

In the end, however, the Census Bureau has no authority to enforce the laws that require the ACS be answered. The Census Bureau can press formal charges for non-compliance, but this is somewhat impractical given the number of forms that are not returned, or that are returned incomplete. A lawsuit would likely draw media attention and a public outcry that would very probably bring an end to the survey or end mandatory compliance. As of early 2007, no legal action has been taken against anyone for refusing to answer the ACS.”

There’s a lot of websites with people posting their experiences getting rid of these leeches. There’s a set procedure and time frame that they go by.

I have a relative who threw that same thing away. A few weeks later, a census worker knocked on the door, and was told to get off the property. The next day, the same census woker showed up with the local police demanding the questions be answered. The census worker was again told to leave private property, and this time spouted off some law that was in violation, to which my relative replied, "Charge me now. I will pay the fine and write a check now, but you must leave now, and I'm not answering your questions."

The worker and the police left, and it's been almost a year and the harrassment stopped. I understand that if the questions are answered falsely, the fine gets bigger.

I received the ACS a couple of years ago. I never returned the form to the Census Department. Nothing will happen to you if you throw the form away.

HOWEVER, be prepared for the Census Department to hound you in person & by phone for about 90 days to fill out the form. After 90 days, they’re off to hound the next victim.

Why the hell would local cops play along? They have zero jurisdiction to enforce silly federal laws. Were they bored? Are the feds supplementing their income?

Soft tyranny is so evil that it’s not even fun to resist. Imagine how much precious time is stolen from people’s lives because they think they have to become little unpaid bureaucrats.

Figure out what the TRUTHFUL ANSWER is and turn it 180 degrees away. How many toilets do you have? Fourteen. How long does it take you to get to work? Either ‘0’ I have no work, or 14 hours. Manipulate as you wish. I did.

I threw mine away three times. They called an equal number of times and I told them I was not filling it out. They visited my remote home while I was not there.

I called the Sheriff, who is a freind, and filed a verbal complaint against them for stalking.

How to Legally Refuse to Participate in the Census Survey (and ACS Survey)

Penalty Provisions for Failure to Comply with Either Survey Request

On their web-site, the Census Bureau states the penalty provision for failing to comply with either survey request is found in Title 13, U.S.C., Section 221.

Pursuant to this section, refusing to provide the requested information or neglecting to complete either survey subjects you to a fine of not more than $100.00.  Willfully giving information that is false subjects you to a fine of not more than $500.00.

Then, in what I believe is a blatant attempt to misrepresent federal law and install fear in the hearts and minds of the American people so they will provide the requested information, the Census Bureau included the following statement after their reference to the section 221 penalties referenced above:

Title 18 U.S.C. Section 3571 and Section 3559, in effect amends Title 13 U.S.C. Section 221 by changing the fine for anyone over 18 years old who refuses or willfully neglects to complete the questionnaire or answer questions posed by census takers from a fine of not more than $100 to not more than $5,000.

A review of Title 18 shows it is entitled:“CRIMES AND CRIMINAL PROCEDURE.”

Section 3559 is entitled: “Sentencing classification of offenses.”  Section (a) states: “Classification.—An offense that is not specifically classified by a letter grade in the section defining it, is classified if the maximum term of imprisonment authorized is—(9) five days or less, or if no imprisonment is authorized, as an infraction.

Section 3571 is entitled: “Sentence of fine.  Section (a) states: “A defendant who has been found guilty of an offense may be sentenced to pay a fine.”  Section (b) states in part: “…an individual who has been found guilty of an offense may be fined not more than the greatest of—(7)for an infraction, not more than $5,000.”  This is the only reference to a fine in the amount cited by the Census Bureau that matches the provision in section 3559 above.

The $5,000.00 fine referenced in section 3571 is a post conviction fine that only applies to an individual who has been charged and convicted of a criminal infraction as defined in section 3559.  Unless an individual has been charged and convicted of some criminal offense connected to the Census and the crime is classified as an infraction, this $5,000.00 fine does not apply.  Thus, their assertion that these sections changed the fines in section 221 to $5,000.00 is…you fill in the blank.  In my mind, it’s a blatant lie that borders on fraud.

I got mine the same time I got regular census form.. . I answered only my name, number of people home and an employment question may e... Don’t remember but I signed and mailed mostly blank. I did not lie, I just submitted incomplete just as I did the original census. Never heard a word.

When the census takers call you, just remind them that since Roe vs. Wade says that the “right to privacy” ensures that you may kill your unborn child, that same “right to privacy” prevents you from having to disclose how many toilets you have.
