I noticed in the Nancy Grace transcript that when NG had Mark Bain (probate attorney) on the ropes, he actually ADMITTED that in certain cirmcumstances (including the circumstances of ANS) that the will would not be upheld and the decendent would die ‘in testate’.
I honestly hope that is how the courts determine ANS’s Estate. If the Will is deemed to outdated or inadmissable or not valid, I will be happy about that. I understand, as another FReeper posted, that more money and/or fees will go to the County and/or Courts, but I prefer that to the money going to HKS! If the will is probated intestate, there is more likelihood that the facts will come out, as far as HOW and WHERE the money went. I would prefer to see that, even if it meant that LA county would get a substantial cut of the ‘as yet non-existent money’!!
Yes, the ‘whole picture’ is getting clearer and clearer! And to add to it, if some people couldn’t see HKS as a person having MBP, just look at who he alligned himself with! Dr. Kristine Eroshevich! Who better than a doctor, to allign yourself with, if you have MBP! It’s really WEIRD, and unbelievably REAL, in the fact that it happened!!

I guess that is what amazes me as well! HOW is HKS able to continue to do everything he wants to do?? My ‘thoughts’ about G. Ben and Ford come from the fact that neither of them have been ANYWHERE in the media, and perhaps that they MAY be concerned about the ‘break-in’ at Horizons. If, in fact, it was G. Ben or Ford who ‘broke in’ to get Anna’s belongings, maybe they are worried that their case will not stand up in the Bahamian Courts, and maybe they are concerned that it will have a negative impact on the Horizons case. At this point, I do not see any WAY that HKS can claim ownership of Horizons, a home that neither he nor ANS ever paid a dime for!!
So, I have to wonder if HKS either has a DEAL with G. Ben and Ford, or he has the biggest BALLS on the face of the earth to try to pull off everything he tries to pull off! I’m also wondering, just out of curiosity, if the latter is true, if HKS’s member somehow manifested itself into a BALL all it’s own!! LOL....just a joke guys! We all know, he NEVER had a member anyway! But THREE balls....that’s a definite possibility!! LOL!!!!!!!!!!!!!!

Was reading the link at artharris. Wonder why HKS can file probate on a will in the Bahamas. Wouldn’t an executor just file either where she died. Why in California? I think it is because he knows that the Bahamas probably woldn’t give him rights as administrator.
I was reading the NG transcript and they also said that the assets could be amended. I guess when HKS got into what was her asset he would (wonder of wonders) find a bunch of stuff he “never knew existed”.
Just wanted to say what a nice group of people there are on this message board. Not anything like the board for the missing British child, where you post your concern for a missing child and you get verbally attacked.

Ya know, with *some* of the legal types, I can parse their statements and see the lies pretty clearly.
With TV people, which is what this Art Harris is (and I apologize for contaminating our thread with his tripe yesterday - it was the first thing in print about the will petitions and it was so outré that it caught me off-guard), they just bald-face lie and don’t bother to wrap any truth molecules inside.
Let’s see, *if* a Bahamian judge really talked to him, which I don’t believe one did, but *if* so, it must be the uncle of that attorney Stern “engaged” for the paternity appeal and forgot to tell him to cancel it. A bigger judge (a SCOTIBA, I guess you would say, lol) has already censured that judge for talking to the media about ANS things, so I’m gonna guess that’s who it might be.
OK. Then the Marshall marshalling - you did see that Bruce Ross said yesterday that $88 million award is a judgment they just have to collect? Yeah, right. And this guy thinks that just maybe the dead Anna Nicole will get $500 million IN MEDIATION? LOLOLOLOLOLOLOLOL
To begin with the $88 million was appealed. I’m sure Howie’s team knows what an appeal is! One of their favorite things. You just appeal and appeal and appeal and keep on appealing into oblivion. (That’s the only time the word *appealing* is ever used in conjunction with anything HKS-related!)
When *they* have an appeal in the works or even if they’ve filed one, they *always* make sure to say that about whatever victory the *other guy* won. They just laugh and say “riiigght, we’re appealing!” Then people think “oh, that’s been cancelled out.” Well, guess what - the $88 mil has been “stayed,” too.
And they are loving throwing out that word “mediation” to make it sound like they’re sitting down with Pierce Marshall’s widow and having tea to discuss whether they should fly together to the Koch Industries board meetings or go in separate planes in case something happens to one of them.
The absurdity of ALL of this is that it derived from ANS’s hare-brained bankruptcy case to begin with! Why don’t they ever go back to that? As usual, she was trying to get out of paying her bills and a big judgment when somebody thought maybe she should have included that pie-in-the-sky Marshall money in her assets.
A decade later, here they still are. The bankruptcy itself was discharged years ago (altho, it would be funny if they *could* come back on her for that one $850,000 charge, if nothing else, to cancel out the minimal CA asset value in the estate and put it into the red).
And as far as HKS being “named the administrator” - by whom? By the probate attorney *he* hired for Anna? Guess what. A COURT has to “name” the adminstrators and executors - and no hearing has happened yet - that’s what the petition is asking and will be heard on June 19.
Stern the quarterback? Oh, ha. That’s what they call whichever lawyer got the short straw way back when and had to baby-sit the berzerko client until her death? That’s usually the water boy.
Reminds me of myself in the 5th grade when the teacher made me the “coordinator” of the class play. She played it all up and said it was the most important job, blah blah blah, yada yada yada - but it was only because I couldn’t sing and she didn’t know what else to do with me.

I especially love the part at the end about how much ANS’s name and image might be worth, and how much she wanted to be like Marilyn Monroe...and then this statement:

*GASP* *Choke* *Clearing my throat*.... Um....Dannielynn is 8 months old. Have any of these people been ‘clued in’ to the fact that Marilyn Monroe suffered a lifetime of depression, emotional and physical abuse, mental disorders, and drug abuse (AS DID ANNA)? AND, THAT is the life they WANT for Dannielynn??? How VERY VERY SAD!! She deserves so MUCH MORE!! The last line in that paragraph is particularly poignant.

In regard to that statement, I ABSOLUTELY believe him! And, it terrifies me for Dannielynn...
I realize that the will had to be probated in the US but not sure why it would have any affect of any kind in the Bahamas. I would think they could settle the Horizons problem without the will. (but what do I know LOL)
You are right: they lie. Far too many lies have been made in this case and the media appears to go along spreading their own. Howard K. Smith deserves the Liar of the Year award. You and the others might yet help bring down HKS. Terrific comments here like questions about the authenticity of the commitment video and inconsistencies of the time line. The authorities should have investigated them but were too eager to give HKS a pass.
Just stopping in to say hello! I’m looking forward to seeing if things move forward next week! In the meantime, I’ve been away in search of tests and treatment for thyroid as well as doing everything I possibly can re: on-going critical and very timely political issue.
I’ll keep checking in to see if anything happens before next week, but hopefully if I miss something I’ll get a ping!

I sure don’t like the sound of Mr Birkhead and Mr Stern getting along very well and PROCEEDING with Anna’s WISHES. Usually when HKS refers to Anna’s wishes its in relation to Virgie. Hopefully this doesn’t mean LB is going along with the Stern’s goal of not allowing Virgie to see baby DL.
I’ll really be mad at LB if he has chosen to pair up with HKS because he thinks he will get more dollars and have a really nice mansion in the Bahamas, do to all of Stern’s dirty tricks. Virgie can’t offer LB any money. She’s just a Grandma who has lost her daughter and grandson. I hope I’m so wrong, but it looks like the ones who are after the money are HKS(which we knew from the beginning), but also Larry B.
I hope Virgie has some powerful lawyers to help her to stop HKS and his dirty tricks. I know this is nuts, but I’m wondering if Larry B has been in on some of this crap with HKS from the beginning.

If LB approves of HKS and his continued efforts to steal Horizons, I would imagine the Thompson’s and the Shelley’s have changed their opinion of Larry Birkhead.
They would be changing it AGAIN. Remember they were in on the scheme to keep Larry away from Dannielynn. I still think they had a DNA test done on Dannielynn to be sure that G. Ben wasn’t the daddy. I think they have their own secrets.

Honestly, I don’t know what to think. I go back and forth on LB - but mostly, am waiting to see what happens next with him, with the inquest, with the legal wrangles. I just don’t know.
I’ve asked another FReeper to bring us up to date on a story that was here on FR two years ago that pertains to the probate attorney. It’s a very sad story which will make everyone mad and will be obvious why Stern is in cahoots with him, as far as “patterns”.
I’d rather the FReeper talk to us, but if not, then I’ll post what little I know in the next few days.

I guess I did kind of jump from one subject to the other there, didn’t I? Started talking about LB and switched to the legal thing that was on my mind, which was about Ross.
Funny about that Mark Bain. When he was on TV so much, I tried to find a profile for him, since I usually post those for any attorney name mentioned for our “players.”
I couldn’t figure out which one he was, out of only 2 in Martindale-Hubbell. I was clueless as to what he was actually doing for LB because no one ever said, even tho he appeared on NG and on FOX News - at first, just as a legal panelist, then saying he was Larry’s attorney.
More recently, as I finally got into my transcript back-reading, I saw that he was Larry’s “former probate attorney” and was in Davey, FL. Then I knew where to look for him, lol. Found him in the FL Bar and he has only been in practice since Nov 2005, practicing in Broward Co.
Guess he was just a special-purpose one-time-only hire? Not sure.
I don’t know what to think either. I possibly am jumping to conclusions based on what HKS’s lawyer said about how close LB and HKS have become.
I miss all the news that we once were getting almost on a daily basis. Hopefully an inquest into Daniel’s death will actually happen. HKS seems to have a knack for winning most all of the battles. His ability to have things go his way, is almost supernatural.

Well, maybe it won’t be soon - I just checked and the FReeper hasn’t posted since late March, but FReepmailed me just a brief comment (on this thread) a couple of weeks ago, in late April.
At the time, I didn’t know what it pertained to, but I do now.
Sorry to be cryptic, but I’m just not sure what happened between the dates I know about and the last one, and the topic is quite controversial, so I’m being hesitant in bringing it up - except to say it shows Bruce Ross in a Sternish light.
I understand that originally the Shelley’s/Thompson’s were helping Anna escape Larry B, by purchasing the mansion for her. However, imho, it appeared as though they had changed sides and were supporting Larry in his efforts to prove he was Dannielynn’s dad.
Further evidence of that was Ben Thompson’s offer made public by Pinder, to allow Larry and/or Virgie to stay in Horizons with baby DL, if Larry was proven to be the dad.
You might very well be right about Ben having a test done to see if he could be DL’s daddy. I wonder if we’ll ever know what Anna told Ford Shelley to do, in case of her death??? He sure seemed to imply foul play had cause her death early on.

I don’t know that much about G. Ben (other than what has been posted here) and he, personally, has been relatively quite throughout this ordeal, but Ford Shelley is another ‘bird’ altogether. He is ‘quirky’ to say the least. He seemed to be a major player in helping to get ANS ‘out of the US and set up as a Bahamian resident’. Then, he seemed to ‘hate’ HKS due to what happened to his daughter at the time of the ‘clown video’, and yet he turned right around in Seidlin’s Courtroom and basically ‘praised’ HKS and said ANS should be buried in the Bahamas! Then again, he defended himself on TV for ‘procuring Anna’s belongings, as she supposedly told him to’! He is a walking, talking contradiction, IMO....I certainly cannot figure him out!
I have no idea. I’m the one who gave the impression Bain was an AL atty on my Case Name List - because there was only one Mark in the nat’l lawyer directory for the US, in Montgomery, AL. The only other one was a corporate atty in Canada!
He was on national TV, so I had no idea what state he was in, except he was calling in from Ft Lauderdale, but this was in March, when there were still courtroom things going on in FL, so that didn’t signify much to me, or what he was doing for Larry - and I still have no idea!
I just don’t want to get into the brouhaha this stirred up before. I wasn’t here on FR for it and where I was posting, I also avoided discussing it, for some of the same reasons that upset others here a few weeks ago.

Yes, I looked him up also and couldn’t find much. I live in Alabama and know quite a few attorneys, so I really should inquire about him. Maybe he used to be in Alabama and moved to Florida....I don’t know...but he sure doesn’t mind going on the talk shows to give his opinion, does he? I just wish ONE of them would ASK him or EXPLAIN what his ‘actual’ relationship to LB is!! It’s bizarre that that it’s never mentioned....and I’ve checked all of the message boards to see where he comes into play...so far..nothing! I even checked to see if he and LB may have gone to college together, since the ALA Mark Bain is pretty close to Larry’s age, but no dice!! That Mark Bain went to Univ of Ala....so I still don’t know the connection. Although it does make me wonder...did you look for ‘relatives’ of Larry Birkhead in Alabama and Florida?? I just don’t see why he would have needed a probate attorney from FL or AL prior to March of this year???
His bar listing shows him to be solo, not with any other firm, but there is a family & divorce attorney at his same suite number in his office building in Hallandale Beach.
