Amazon update #7: Amazon is now saying the reason they banned my anti-Obama book is because I don’t own the copyright to my book which I wrote

And now, on with my seventh update:

I recently received the following email from amazon. The bolding is mine:

We discovered territory selections are preventing the following book(s) from being available in any Amazon marketplace:

The Least Transparent Administration in History by Daniel Alman (ID: PRI-YVE214K3B8S)
In order to publish the book(s), please take one of the following actions on your territory selections:

Option 1: Public Domain Titles
1. Review your selected territories to ensure they’re correct, make any necessary updates
2. Resubmit your book(s) for publishing
3. Reply to kindlecontent-review@amazon.com with the following information:

1. Author name(s) (all):
2. Author date(s) of death (all):
3. Initial publication date:
4. Initial publication country:
5. Website link(s) to confirm:

That bolded part is very peculiar, because when I originally published the book more than four years ago, I told them that I was the author, and that I owned the copyright. Since then, the book has sold more than 1,500 copies.

But now, all of a sudden, after more than four years, and after selling more than 1,500 copies, they have decided that I no longer own the copyright to my book which I wrote.

I responded to them with the following:

August 19, 2020

amazon KDP

I own the copyright because I am the author.

All of the territories are correct.

Daniel Alman

However, my book is still banned.

I just found a link to your blog on The Liberty Daily titled “Amazon Claims They Banned Anti-Obama Book Because Author Who Wrote it Somehow Doesn’t Own Copyright to Book He Wrote.” Did you know about that?

Did you go through the formal copyright process for the US and other areas?

I used to have to do that with photos.

could you just copyright the work in the US and limit distribution to the US and give them the copyright #?

That hasn’t been required for years. If you ever hope to use the legal system to protect your works from infringement it is. Most lawyers won't even touch an infringement case without a registered Copyright. As for this Amazon situation, the author wouldn't have this problem at all if they merely sent Amazon the Registration #--they obviously know the author didn't splurge for the $55 registration.

Generally, all that is needed for Amazon to take something down is for them to receive a complaint, typically unsubstantiated, that a third party's (intellectual property) rights are being infringed.

This is unfortunate but a fact of life in the business world.

Sometimes it can take years to prove things to the satisfaction of a company (such as AMZ) that doesn't need your work to continue doing well, and sometimes they just cease doing business with you for their own reasons anyway (such as to limit their exposure).

They already approved if four years ago. Now they’re just coming up with one bogus excuse after another to ban it. Their previous excuse was that I did not own the right to the public domain photograph that was on the book’s cover.

maybe it is a new policy designed by their internal legal department to help shield them from any possible IP lawsuits? figuring that the seller should be able to afford to jump the relatively low hurdle of copyright fee and time to set it up online. might be worth a consideration if not already done so...
