"So the count for shell casings--I'll recap that Officer 1 the trooper shoots three times as the truck is approaching. Then there are two non trib shots as LaVoy Finicum gets out of his vehicle. One strikes the top of the truck--that's the bullet hole in the top of the truck--and then Officer 1 shoots LaVoy Finicum twice, and Officer 2 shoots him one for a total of eight rounds....."

Grand Jury testimony from Special Agent Russ Cunningham-DOJ Office of Inspector General in FBI Agent Astarita case January 26, 2017

The defense in the case of FBI Hostage Rescue Team Special Agent W. Joseph Astarita has released government documents as they try to debunk the Oregon shooting investigation that points to Astarita taking two shots at LaVoy Finicum's truck as he went into the snow at a roadblock on January 26, 2016.

One document is the grand jury testimony of Special Agent Russ Cunningham, from the Department of Justice's Office of Inspector General.

Cunningham revealed that two Oregon State Troopers fired at LaVoy Finicum when he was killed. There were three shots total with two from one trooper and one from the other.

"Officer 1 the trooper, he shoots him twice, bang bang, and Officer 2 basically from the centerline down here shoots him once. He's offscreen so you don't see the trooper."

A third trooper was opting to use a taser on Finicum when the other two opted to open fire according to Cunningham's testimony.

"The guy up in the woods line is Officer 3. He was going to hit him with a Taser, but as he turned and reached for his gun they decided to shoot him."

Cunningham alsp explained to the grand jury the use of flash bang rounds designed to shatter windows on vehicles in connection with the other shots fired.

He also described the operation that killed Finicum as FBI led and intended to arrest people in the pickup truck.

Astarita's team of defense lawyers are trying to discredit the Oregon shooting team investigation to exonerate him.

FBI Special Agent Astarita is charged with three counts of perjury and two of obstruction of justice.

There are no charges against him for killing Finicum or injuring Ryan Bundy, who still has shrapnel inside him after being injured during the shooting, apparently from Astarita's gun.

A pretrial hearing is set for May 21st in Portland with the trial set to start July 24th.

Astarita’s team of defense lawyers are trying to discredit the Oregon shooting team investigation to exonerate him.

FBI Special Agent Astarita is charged with three counts of perjury and two of obstruction of justice.

If it were the other way around, the FBIs and DOJs Civil Rights Division would have already told the defense that they intend to either put the officer(s) in prison, forever, or bankrupt them til they take a plea.

But, when their asses are on the line, OH No!!!, you can’t treat us like that. All you guys, the one’s we used to work with and high-five and thank for all your help, you all suck and have no idea what you’re doing. If any member of law enforcement, on the state or local level, helps the FBI in any way, they should immediately be fired and never be allowed to work in law enforcement every again, anywhere, anytime.

“There are no charges against him for killing Finicum or injuring Ryan Bundy”

This two tired “just-us” system has got to go. FBI = Gestapo. So much for the corruption being limited to the top. It’s State and Federal, boots and suits.

LaVoy was hit in the left side and it knocked him to the left.
He automatically grabbed toward his left side when he was hit and his body turned. Which is what anyone would do.

Exactly what they wanted him to do. I’ve seen that video too many times to believe any differently! WITH believes the ‘killers’ story? Not me.

I wouldn’t trust the FBI with a glass of water. Time to disband that corrupt organization. They are a disgrace to this country.

The OSP shooters will got cleared. The FBI agents will go down for false statements and obstruction. Finicum’s public statements of not going down without a fight will be brought up in the totality of circumstances.

I heard from a DC source that this FBI agent was not HRT, but on a SAC SWAT team. I would think if this was true the FBI would have clarified that confusion.

“So, the FIB “Hostage Rescue Team” fired some rounds at the people they wanted to take hostage too?”

Hostage Rescue Team, SWAT, State Police, etc are all just euphemisms for government hit squads.

The shooting was no more than assassination from what I saw.

Testimony of drawing a taser introduced possibility that non-lethal force was possible, which was suppressed by judge in the trial. The defense that officers feared for their lives should have come off the table. So who was the fed agent who spoke to the two (Ore) troopers who went lethal, in light of the deceitful practices commonly used by fed agents?
