It should be 1 year hard labor for the 1st re-entry and 5 years for each additional re-entry. Give the penalty real teeth or they’re wasting their time.

No, it was always a felony. The AG doesn't have the authority to change the classification.
After Removal Is a Felony. ... The law accompanying § 1325 is 8 U.S.C. § 1326, which makes the offense of reentering, or attempting to reenter the United States after being removed or deported, a felony offense. You will likely be permanently barred from the United States if you illegally reenter after a prior removal.
