Comey’s statement at the time and his conclusion not to recommend prosecution were largely based on his opinion that there was no criminal intent. However, there is no requirement of intent relative the law in these cases. Many government employees and government contractors have been prosecuted and even jailed over far less serious security breeches related to classified materials. Even when the breech was purely an accident and totally lacking criminal intent.
