Marilyn Mosby may have an ethical obligation to abandon the rest of the Freddie Gray trials

With the complete acquittal of Caesar Goodson this week, the argument being made by Maryland State’s Attorney Marilyn Mosby has essentially imploded. Goodson was allegedly the “most culpable” in the death of Freddie Gray and the one officer involved in the incident who might have been convicted on any sort of charges. There are still four more trials slated to take place, however, all of which would grind more salt into the wounds between City Hall and the police force. Should they even continue? Legal experts are weighing in on the subject and there’s a fair case to to be made that Mosby should simply quit while she’s behind. (AT&T News)

-- Does conducting her own investigation expose Mosby to personal liability in the various lawsuits filed by the officers? --

Yes, but barely. As DA she has near absolute immunity for charging decisions, but she can be found liable when she forays into investigation, which is not the DA's core function. That said, she can bring a turkey of a case using outside evidence, and the only remedy is to reject her charge following the presentation of evidence at trial.

Moseby did approximately what Angela Corey did to Zimmerman. Mount a political prosecution that flies in the face of the evidence. The legal system totally relies on good faith on the part of judges and prosecutors, and when that is absent, the system has no practical means of internal correction. A finding of innocence "cures the problem."

She’ll go down swinging. She’s too arrogant to admit failure.

Forget about ethical considerations. Those were probably abandoned by Mosby some time ago.

What’s left are the practical considerations. It should be obvious that if the three trials of what were advertised as the monst heinous of the defendents ended without a conviction, Mosby should simply admit defeat and move on.

What is the point of continuing the embarrassment and the cost to tax payers in a vain attempt to vindicate poor judgment?

Mosby has no clue what ethics are.

Isn't this the moron who claimed she was a 5th generation LEO?

She based that claim on the fact that four of her relatives were police officers. Every one of them was dirty!

I think that putting the words “Mosby” and “ethical” into the same sentence creates a major incongruity.

I’m not sure she’ll be derailed. Mayor Space to destroy Blake is not running for re-election, hopefully her stellar career is swirling down the toilet. Several city council members are retiring also

Dream on. Those officers did nothing wrong except to bust a drug dealer, on orders from the State’s Attorney, Marilyn Mosby.

Before you go passing judgment, I suggest you educate yourself on the case and the trial.

Legal Insurrection is a good place to start.

On Twitter, @joylepolastewart is another one. She’s a local reporter who live tweeted the testimony.

Even prosecution witnesses were providing exculpatory evidence

The Medical examiner was nearly accused of perjury, Mosby claimed the Sheriff Department conducted the investigation. She Sheriff said he had nothing to do with it.

This is a pure, outright witch hunt. Mosby hates cops.

She’ll talk all about how she’s from a cop family. However, her family history is filled with cops who lost jobs and went to jail for corruption. This is payback.

Mosby is married to that jackass council member Nick Mosby who got chippy with the Fox reporter, who asked him if looting the corner liquor store was a legitimate expression of protest and he told the world that civic violence in his district was a “cry for help”.

These acquittals look good on the both of them.

Don’t care. Freddie Gray was a pos, some of the officers involved are pos and Mosby is a pos.

They all get what they deserve except for the actual death of Freddy Gray.

Freddy gray probably deserved some form of punishment and he got it, a bit to harsly, but at the hands of people who aren’t given the responsibility to apply lethal police street punishment.

Mosby’s career is ruined, not because she prosecuted, but because she tried to leverage political gain and turned it into a circus.

The officers get chastised, indicted, ruined careers, bad reps and I hope it cost them money and family grief. But only the officers that actually left in the van from the initial arrest of Freddy Gray.

It’s semi-win, win, semi-win situation to me.
