In the comics, Thor indeed inhabits Dr Blake’s body. But in the Marvel Comic Universe, the recent movies, he is straight outta Asgard. The first movie mentions a Dr. Blake as a cover name for Thor when talking to authorities.
Also, in the recent Civil War books storyline, Tony Stark establishes diplomatic relations with Asgard.

Since Thor was sent here to protect the Nine Realms, and Earth is a member of the Nine Realms, then he’s here under superior law enforcement jurisdiction. Like when the FBI operates within a State for the purposes of enforcing federal law.
